    Interesting to see the latest version of Commentary denounce this as a crackpot theory. They don't see the case closed but then I suppose serious conservative journals like this are just communist conspiracies eh?

    I hope the Georgia verdict is as above as there isn't a snowball's chance in Hell that the SCOTUS will support such an interpretation of the Constitution. I don't think this legal argument is a conspiracy though. I do think it provides a great opportunity for the SCOTUS to rule in favour of jus solis even in its application to the Presidency which I admit is a slightly adjacent principle. This will be a great blow against racist scum everywhere who want to deny citizenship and rights to people they see as aliens in direct contrast with common law and to the ancient liberties of common law jurisdictions, including England, where jus solis has scandalously been abolished by statute.

    This view is based on the fact that SCOTUS did not refer to Wong Kim Ark as a natural born citizen. Of course it did not say that he was NOT a natural born citizen. And this case was about whether he was a citizen, not a natural born citizen, even though it was citizenship based on birthright.

    It's a tiny ***** of light to the birthers that the SCOTUS should dim. Given that it is only extremist conservative opinion that wants to deny NBC status to someone born on American soil to an American mother, it is highly unlikely that SCOTUS would not strike down the judgement of the Georgia Court. The SCOTUS has determined that the citizenship issue is determined according to jus solis, rather than jus sanguinis, and follows English common law tradition, not "international" Napoleonic Law tradition, except in the case of children born to US citizens overseas, where jus sanguinis applies, (as it does in English statute law as well).

    The argument that Obama was not an NBC because he was born British under the British Nationality Act of 1948, and therefore cannot be an NBC as this would involve dual citizenship has already been defeated. Under this argument of course JFK would not be eligible either as anyone with an Irish grandparent is de jure an irish citizen according to Irish law. It would disqualify an awful lot of Americans from NBC status.

    I do not think this is a conspiracy theory though. It is an important debate and part of the debate that sets those who think that laws should all be by statute and fixed (the despotic, tyrannical, Napoleonic tradition - ironically once termed "international" law and favoured by conservatives in Wong Kim Ark) and those who think that laws should be based on statutes and on ancient customs (English common law), derived from the common peoples' historic struggle against lords and monarchy, which are from time to time gradually re-interpreted to fit the mores of the times. When conservatives deride judges as lawmakers, they are deriding the common law system and the ancient wisdom of the common people that it embodies.

    More accurately, when liberals defend federal judges who presume to exercise legislative authority, they deride the Constitution.

    And such wisdom teaches that power is more prudently vested in a handful of unelected judges than in hundreds of elected legislators. Have I got that about right?

    Some of these folks are stuck in a 6th grade reading of the Constitution.. which says alot about US public school education.

    Very sad IMO... Any level of critical thinking and education would clear this up.

    Each of these crackpot lawyers has a website and each is asking for 'donations'.. This is a rip off.. and they are counting on the ignorance of the birthers.

    You know.. before I retired I served on a tri-county development board... and I could see this economic downturn coming in the mid to late 1990s.. so I was panicked for my children and their investment choices.

    By the time Bush and his Neocon posse were finished, I knew that there was NO quick fix for the economy.. Perhaps I never expected Obama to work a miracle.

    But, so far he's done a pretty fair job with foreign policy.. and from all I see he's a thinking person who cares deeply about our country.

    I think he's a good man.. Having said that.. I would have voted for Huntsman if he'd ever gotten any traction.

    Our problems are structural.. if we could get off the partisan idiocracy... we should put all of Congress on notice that they are a lazy, greedy bunch who have refused to address the issues.

    My baby brother used to say that if he was president, he would make it clear the he was only a "referee"..

    I don't think you will, but I can try to get you to make a cogent argument none the less.
