    I have a feeling you don't understand the standard I am applying here in this thread. I am asking whether a DA could get 12 jurors to convict on a criminal incitement charge. Do those statements about the election prove to you as a juror, beyond a reasonable doubt that on 1-6-21 Donald Trump intended to direct these followers to storm the capital, brake through gates, doors windows, plant pipe bombs, or kidnap and murder people in the next hour. Because they would not prove that to me . They tie him to a possible motive, but not violence as a tactic . Unless you have a page from his personal diary saying these were the tactics he wanted employed to accomplish his goal... it does not prove an incitement to violence charge based on the insurrectionist acts of those thugs on that day

    I think the re-tweet, after he knew what happened the first time he spoke, is a validation of the violent tactics employed earlier.

    Yes, he actually started the rigged/fraud election back in the summer.
    It went on all summer.
    It ramped up bigly after 11-3-20. And he still hasn't conceded. Those are facts and clues.

    He can't admit losing. Which is why he started framing the rigged election months before the election even took place.
    The storming of the Capitol wasn't just the words of Jan 6, 2021. They started in 2016 when he lost the popular vote and tried and failed to find fraud in the last election when his commission he put together disbanded without any evidence at all.


    Then there's the 50 governors certifying their states electoral board and commission results. Which contain both D and R members.

    AG Barr stating not enough fraud to change results.
    Krebs stating this was the most secure election in USA history.
    SoS of Ga, claiming there is not fraud or election miscounts to change the outcome. Even after 3X counting the votes, the last time by hand.

    He played this anger for months and months.
    And called for the gathering in DC on Jan 6, 2021. Knowing full well, IMO, that inciting a crowd could lead to chaos.

    What we know is that he wanted them to do something and he used a lot of slimy lies to inflame their passions that day. But he never told them to storm the capital, to knock in the windows, to plant pipe bombs, to attack the cops, or kidnap Pelosi. How do you intend to prove to a jury that he wanted them to do more than march, hold posters and scream slogans? Its that piece of a criminal incitement charge that was missing here and that is why I claimed there was no way a prosecutor could win in criminal court. My OP was about finding that missing piece in his retweet in the middle of the insurrection he knew was happening in real time, if you ( a prosecutor) could not find it before the insurrection started.

    An angry mob. A anger he festered since Summer. Stating if he lost, back in the summer, that the only way it could happen was if the election was rigged.

    20 times in Jan 6, 2021 he told the mob to fight. 1x, in the 1st 15 seconds of speech he used the word peaceful. 20X after that he said fight. Also stolen, rigged.
    He knows how to rile a mob.
    Lets march to the Capitol. Together. Then he went home and watched as they rioted.

    And during the riot. where some chanted, hang Mike Pence, he didn't bother to tell them to stop. 2 hours later he said they should go home. You are hurt, the election was stolen, but go home. I love you.

    Thank you. You know, if Trump had made a much greater effort to stop the attack, reacted with outrage as any normal person would, all of which he did not, he praised them, continued to give them the fodder they used to attack ( dems stole the election )
    etc., if he would have done what he, as president, was supposed to do, given this oath of office, to protect against foreign and domestic, dems would have a much weaker case, but that is what puts this in the criminal realm.

    Youre refering to a case which considers only a singular speech. When you consider the argument dems president, that it was over many speeches, over a period of many months, filling the minds of his followers with dems stole the election, that their mounting hatred which was the volcano that erupted on Jan 6, then it changes the dynamics of the issue.

    Moreover, we are not talking about Harvey Milk, we are talking about the words of the president of the united states, which carry far more weight than any other citizen.

    Our Framers were also quite familiar with a Monarchy and absolutely forbade it.

    This farce has fooled few.

    WHAT IF WE HAD AN IMPEACHMENT AND NOBODY CAME? Few expect Trump conviction, even fewer to watch Senate trial.

    Trump only lied about Pence having the authority so he could deflect responsibility from himself. What happened to the whole idea that Trump would declare martial law and re-do the election in swing states? Why aren't his minions angry at him for not following through with the plan like they are with Pence?
