ok since this is about guns, do you think it is proper for cities or victims of gun violence to say sue Beretta because a crook who stole a gun from say a police department, then uses the Beretta to kill someone? or in the case of Lanza, Mrs Lanza bought a rifle legally, the gun was sold legally, but then Lanza murdered his mother, stole the rifle and shot a bunch of innocents

When you pay out and you don't get a stipulation as to privacy and non admissions of guilt etc, what you paid out is assumed to be what they suffered.

That's how it works in civil law dude. This is why standard arrangements are 1) no disclosing the amount of the settlement; 2) no **** talking the other party post settlement; 3) no admissions of fault or guilt by either side, normally accomplished by a mutual take nothing judgment wherein each side bears its own costs and 'takes nothing', along with a rule 11 agreement entered by lawyers, money exchanged, and a confidential settlement agreement laying out the specifics that the court doesn't need.

If you don't get that, its because you're at fault if you're paying out. That's WHY those lack of admissions for paying out clauses exist. Because otherwise, that's exactly what it means.
