So if two 15-year olds have sex that they agree they both wanted, are they both rapists? I think there's two things to consider here. First, it's capacity. Do they understand the act and what consenting to it fully implies in terms of risks and benefits? Second, there's concern about a power dynamic. A young person may claim consent, but if it was in the context of somebody who had power over them through authority or just experience, it can call true consent into question. All of these things are going to vary by the persons involved and the situation. People don't wake up on their 18th birthday and suddenly have a dramatically increased capacity for consent in reality, despite the law, but this fact should not be twisted to help people exploit others, either.
Ya, that's what I'd like to assume they're talking about. But the wording they used does not preclude sex between a minor and an adult. And frankly, I have trouble believing the UN missed something that obvious on accident...
You know what's so so ironic? These same people are all for younger people to be able to have the right to have casual sex, but at the same time have been against laws allowing girls under the age of 18 to marry. Someone cynical would almost think they wanted teens to have lots of sex with random different people outside of marriage. Guess that's progressivism...
The point was that they are correct in the sense that there are cases where one under 18 could consent to sex, such as mature 15 year olds with mature 15 year olds. So unless you believe 15 year olds having sex is inherently rape, the real potential concern is power dynamics compromising consent rather than the ability to consent by the ethics definition.

The point is that the capacity for consent is there and implicitly acknowledged, so it not being prosecuted supports my point. In terms of the point of what the UN says, as #Monash said I think the idea is that high school seniors/juniors having sex with high school freshman isn’t usually actual rape and prosecuting such seniors isn’t just. I recall some states in the us have used “Romeo and Juliet” clauses to allow sex with a difference of 3 or 4 years to reduce ridiculous prosecutions.
if two 14-year-olds have sex, they both consent, yes, they consented - now you can say they did not consent and both are rapists, but I say they consented if they consented can you make it a crime to have consensual sex underage, sure, but it's still consensual sex

there is consensual sex and unconsensual sex, there is a huge difference between the two there is also illegal sex and legal sex and yes, consensual sex can be illegal in some circumstances, such as an adult having sex with a minor
