Colorado Openly Repudiates Federal Law

    Recent estimates of the tax revenue to the state from pot sales are above $60 million in this first year.

    The pot sellers cannot deposit their proceeds in banks, so it will be interesting if $ 60 million is paid in 100 dollar bills.

    And yet for the last 200 years we have decided that is what the Supreme Court does.

    Not a perfect system but better than the alternatives that I have seen.

    It's not just those two states. Many more places have medical marijuana and they get the same exemptions. The government will split hairs here and say that people who grow or traffic drugs in ANY state without the requisite state licenses will get prosecuted. If your state has no licenses they can prosecute you just as they always did. They will say that makes the law uniformly enforced as far as they are concerned. In other words, they are essentially choosing to uniformly accept all state laws in this regard. Like with marriage. Whatever your state says is accepted by the Feds (since DOMA was overturned). So gay marriage is recognized by the Feds for some people, but not for others depending upon whether a particular state allows it. In practice (for now anyway), the new Federal marijuana law will be whatever your state says.

    I know what the establishment propaganda regarding the supreme court is, I'm contending that it's erroneous. Since you seem to disagree, I'm wondering what legal document or theory you're using to support your position. Where does the constitution or the federalist papers say that the supreme court is the final arbiter of the constitution?

    It seems to me the check-balance is Congress's ability to override the SC? Yes?

    first of all im for making marijuana legal. but what I find hilarious some of the same states that are pushing to make smoking marijuana legal they are pushing to make smoking tobacco illegal. the logic and hypocrisy of the left never fails to entertain me

    Medical marijuana has been sold in California and Colorado for years- in California they are sold through special 'clubs' which require basically a doctor's permission slip.

    Which states are pushing to make cigarette smoking illegal?

    I think the same smoking restrictions should apply to both cigarettes and pot- who wants someone smoking a joint at the table next to you during dinner?

    There is a whole thread dedicated to discussing opinions on why the Supreme Court doesn't have the authority to decide constitutional matters. Don't feel like rehashing something that I am satisfied is settled.

    Now, if a bill introduced last month by one Golden State Democrat becomes law, California would likely become the first state to prohibit millions of its citizens from smoking in their own homes

    Last month? That bill was introduced in February 2013- and has gone nowhere fast.

    I agree the proposed bill is wrong- but again what states are pushing to make cigarette smoking illegal?

    when you try to ban smoking from almost every where are you not basically trying to make smoking illegal

    Yes- I do believe that the one legislator who proposed that probably was.

    That legislator does not a state make.

    So again- what states are trying to ban cigarette smoking?

    Don't you know selective enforcement is just fine, as long as you agree with it?

    Of course the same principal applies with dictatorships.
