Will Bergdahl be tried by a jury of his peers?

    This is the way I see it. The WH/Pentagon can only save face by declaring this soldier mentally defective. No legal recourse and very little political fallout. Bergdahl goes away.

    My biased opinion is he is a (*)(*)(*)(*) soldier that will never set foot in a VFW or Veterans Day Parade. From this point on he is looking over his shoulder.

    If Bergdahl is declared mentally defective to cover Obama's ass, you will have to admit he will fit right in with most of the Obama admin, including Obama himself.

    No. It's a VOLUNTEER military. He un-volunteered. Soon it will be mandatory for males and females just like it is over at the farce that owns your ignorant flag waving aszez, IsNtReal.

    Says the man who writes in sentence fragments, and who use hyphenated nouns when they should have used three words(know-it-all vs know it all). It's silly to criticize people online for their grammar and spelling, unless you are an example of perfect grammar and spelling (or at the least use it when you criticize them.) I only criticize the hypocrites.

    Correction. According to the UCMJ, he will be tried before a panel of enlisted personnel. No officers can or will sit on the panel.

    He will have an officer to act in his defense but he make ask for and pay a civilian attorney.

    The prosecution will be represented by an officer from the Judge Advocate General Corps and the judge will be a very senior JAG member with extensive experience.

    What exactly would be his crimes? They say he walked off base, so I guess desertion? What else? is that what the charge would be?

    As someone who spent the majority of his adult life in uniform, I feel justified in criticizing people who haven't when they attempt to portray themselves as military experts.

    Only if during a declared war, I believe.

    You didn't criticize his content, but his spelling. I'd commend you criticizing his content, which you have not done. Criticizing spelling or grammar is just petty, and doesn't advance the conversation.

    and what I criticize about all the chicken hawk righties on here jumping all over this poor guy is that none of us knows all the facts of the case... not even knowing how to spell court-martial was just icing on the cake. The military will determine whether an offense against the UCMJ has been committed by Bergdahl and they will also determine how to proceed if such an offense has been committed. I am not going to judge the man. I have not been called out of retirement to sit on his court-martial and I doubt I will be. I will wait until he has been found guilty by a court-martial of any offense before I stop presuming his innocence.

    In any case, people should be catching simple spelling errors or wrong words (such as their, they're and there). I'm not looking for perfection, that's for sure.

    I'm sure your writing isn't perfect either.

    But when someone is purposely being a snarky, smart ass... how about getting 'more' of the basics right?

    I'm not talking about using formal writing skills here, people break rules often in these fora. With Google, spelling is pretty easy to get right. ;)

    Nitpicking spelling and grammar does nothing to advance any kind of information exchange. I only do it in response to others. I will admit, my writing isn't perfect, but then again, I don't criticize anybody's grammar that isn't nitpicking others. Attack their arguments and their facts, not their spelling.

    In terms of spelling, most spell checks don't work well on homophones, like martial vs. marshal. Both are real words, spelled correctly.
