Democrats have their underlovlies in a bunch when republicans say that the person elected in Nov should name the new SC justice. However--------------Back in 2007 Schumer had democrats pass a resolution to block Bush from naming a new justice, and the naming should wait for the new president. IMO democrats cant have it both ways. What is good for the goose is good for the gander. Besides having someone as stupid as Obama naming another justice just shouldnt happen.

This is correct. The president has the obligation to nominate a replacement. The Senate doesn't have the obligation to confirm the nominee. Chuck Schumer was playing politics in 2007 same as the Republicans are now. Shocking. Politicians playing politics. I guarantee you if George W. Bush were presented with the opportunity President Obama now has he absolutely would have nominated a replacement in his final year in office. And the GOP would have backed him and claimed the Democrats opposing it were obstructing the Constitution. This is how it goes. Both sides are hypocrites.
If the situation were reversed - lame duck R president and Dem-controlled Senate - there is no way in a thousand years the Dems would let a conservative justice get confirmed. No way. Anyone with any intellectual honesty knows it.
