    Exactly. The requester of a loan provides an estimate of what the assets comprising the collateral are worth. The bank may not agree with the valuation and adjust accordingly. That’s exactly what happened.

    And what makes you think that Dershowitz knows more about NY law (Dershowitz lived and practiced law mostly in MA) than Judge Engoron who has served in the NY bench for over 20 years and has been practicing law in NY since 1979

    The judge doesn't know the difference between appraised value and assessed value. That proves the judge doesn't know his ass from a hole in the ground...lol

    Any bank which did not proper analyze valuation and risk would soon be out of business. DB is a fiduciary. Trump’s valuations came with a disclaimer. DB analyzed valuation and determined risk and set the interest rate. The loan was granted and paid back on time with interest.

    Trump's properties were not just valued appraised or assessed value, they were valued WAY over both.
    Trump also misrepresented square footage in his financials.

    What you are arguing is that if a person drives down the highway at 150 MPH, and doesn't happen to cause an accident or death, then the speeder
    can't be charged with a crime. Law doesn't work that way. Sorry.

    It's also illegal in NY to lie about assets.
    This is really simple.
    Did Trump break NY law? Yes, by strict adherence to the law, he did, accordingly to several judges in NY.
    Is Trump some kind of financial genius? Apparently not, because if he did things at least half assed he wouldn't be where he is today.
    So best. he's a financial genius that was railroaded and at the least he's a cheating scoundrel that doesn't care about the rule of law.
    I submit that Trump is in the middle, he's a spoiled brat that never learned that the rule of law applies to him. but that there are people out to get him.
    Seems to me like that's how life goes for the rest of us. And THAT is what Trump's popularity is based upon.
    "He's like us, oppressed!" And I can understand that emotion.
    BUT, you've picked the wrong representative. Good idea, wrong person. Better luck next time.

    If I buy a gram of cocaine from a buddy of mine, and he is happy with the money I gave him and I am happy with the cocaine I bought, is there a crime?
    One could put forth the situation that Trump AND the lender were benefitting from an illegal act, but that doesn't make the act legal.
    They busted him, he should have been more careful, but facts are facts.
    And the local laws are laws.

    Yep! There right there is the admission of fraud. An honest broker does not need a dusclaimer. But this was a habit - he has been found to have defrauded other multiple multiple times - he is still doing it to his base - using money donated for campaigns to pay his legal bills
