You're misreading that. It means IF you falsify business records to commit another crime the the whole thing becomes a felony. You don't have to be convicted of the other crime it can be the reason you're falsifying records. IMO: Trump's defense should be a hell of a lot more concerned about Pecker's testimony than Cohens. They already know 99% of Cohens's testimonies/documents/tapes.
