He violated the Establishment Clause of the Constitution. This have zero with him being in Congress, or not. One would believe a judge should be well versed in such a thing. In this case, he clearly violated this oath to support the Constitution. State law does not take precedence over federal law. He was in clear violation of the decision by the SCOTUS, advocated non compliant and was suspended by the ethics committee. If he "knew" the law, he wouldn't have been kicked out once and suspended a second time.
