There's no doubt Obama cannot use his executive order power to avoid enforcing actual federal law and instead enact the Dream Act law, in effect, that congress refused to pass. The Supreme Court must not allow the blatantly unconstitutional precedent to stand.

The case being led by Texas and filed at the Federal Court in the Southern District of Texas said the executive order announced by Obama last month violated constitutional limits on presidential powers. Texas Attorney General Greg Abbott, a Republican and the Texas governor-elect, said the lawsuit is not asking for monetary damages but is seeking to have the order declared illegal. The White House has said the executive order falls within presidential powers, and has argued that the ultimate answer is for Congress to pass meaningful immigration reform. President Barack Obama's plan would let up to 4.7 million of the estimated 11 million undocumented immigrants in the United States stay without threat of deportation, including some 4.4 million who are parents of U.S. citizens and legal permanent residents. "The President is abdicating his responsibility to faithfully enforce laws that were duly enacted by Congress and attempting to rewrite immigration laws, which he has no authority to do," Abbott said. Many of the states in the coalition are Republican strongholds and include Alabama, Idaho, Mississippi and Utah. When disputes arise in our country the mechanism we use to resolve them is the judicial system; in this case 17 state feel the law has been broken. The current administration feels that this is not so. Use the accepted system to resolve the issue. Whatever the outcome, if in favor of the 17 states, the let the decision resolve this issue; if on the other hand, the decision is against the 17 states, let them heartily put aside their concerns and move forward. May the best man win!
The states are moving to protect the rights of their citizens, as they are sworn to do. The Obama Adm. is also, but, apparently, doesn't see a problem with IGNORING THEM.
They are free to sue. The president will argue the executive is not "abdicating his responsibility to faithfully enforce laws that were duly enacted by Congress " but rather prioritizing enforcement as there is just no way possible to deal with all 11 million undocumented workers with the resources at hand. It is just commonsense to direct resources where they can be most effective. The issue is mired in politics. Perhaps a court ruling will return some sanity to the discussion. But I doubt it. As this type of enforcement prioritizing occurs every day for every law, the administration is more likely to win the suit than lose it. The commonsense solution would be to pass law. But the fringe right won't allow that to happen - so states will spend money to satiate the far right's appetite to fight Obama. Yawn. max
The states are acting in the interest of their citizens. I like how the overwhelming majority of Americans who want the border secured FIRST, are now "the fringe right". More reasons as to why you and yours just got thrown out on your asses.

Is this the same current administration that was caught on video a couple dozen times saying "I am not an emperor, I am the President of the United States. I do not have the authority to unilaterally change current immigration laws by executive order". Is that the good faith argument you really wish to pursue?
They don't have to just remove lots of benefits using Federal Laws and enforce the laws on the books. Here is a big one since using a false identity document is illegal at the state level and Federal level if a Federal ID (social security card and number) and is a felony just toss the perps in prison and break up families when you can. Then as felons once about to leave you can process them out and deport them under priority already set by the President. If not use state law that is usually four crimes falsifying a birth certificate, ssn and the photo id and maybe green card bump the misdemeanors up to an added felony and toss them in state prison then move for deportation as I noted. As for other things they could do there is a requirement the children get an equal education and ER access can't do much there but you could require a photo ID issued by the state ,photo ID or drivers license, to access any program where government money is used and they must be verified if not legal see above - arrest them and deport. But I'm not an ogre I have a simple new law you want to stay include the normal ways and add this you can just buy citizenship for say $500,000 per person in a family coming in at the same time here illegally or not. Anyone with $2 million for a family for four likely worth bringing in and add the cost of a background check by the NSA to that per person. If Mr. Illegal can pay $500k in cash and pass a background check he pays for that's fair.
Prioritizing arrests are one thing.... proactively issuing green cards and work permits (at great cost) and facilitating law breaking is another. Take it to court. You lose. It's that simple.
The executive action can be overturned in court OR by Congressional action. Of course, we know the GOP controlled Congress isn't likely to act on this. They have more important things to do like increasing the deficit by $400+ billion and trying to shut the government down.

Yeah, I read that before weeks ago. I can summarize what's wrong with it very easily for you, if you'd like. Yes, Obama has a certain amount of latitude in enforcing federal immigration law. No, that doesn't mean he can just stop enforcing the law for millions and it certainly doesn't give him the right to give certain affirmative rights (like issuing work permits and green cards, etc. to millions of people here in violation of federal immigration law) completely nullifying legally enacted federal law. I hope that clears things up for you. You seem very confused.
