Donald Trump accused the "deep state" of trying to ruin his presidency from Russia collusion to two impeachments, but the 45th president may have gotten the last laugh 18 months after leaving office when a Supreme Court infused with three of his appointees drastically reined in the powers of alphabet-soup federal bureaucracy.

Thursday's ruling in the case of West Virginia v. Environmental Protection Agency significantly confined the ability of unelected federal bureaucrats to make law or policy outside of Congress.

In the decision written by Chief Justice John Roberts, the court held 6-3 that under the so-called major questions doctrine, judges can strike down federal agency regulations that have substantial economic effects when Congress did not give explicit authority to the agency to make such decisions.

The federal bureaucracy "must point to clear congressional authorization for the power it claims," Roberts wrote in a ruling that shook Washington on Thursday.

You can read the ruling here:

    20-1530_n758.pdf
While the court decision involved the Environmental Protection Agency and its efforts to restrain coal-fired electric plants, experts warned it could have vast impact on regulatory agencies across the nation's capital, forcing them to prove Congress gave them explicit powers before they impose new federal rules.….

he writer makes some great points. Trump indeed is getting a last laugh at part of the deep state, the unelected bureaucrats. His justices have returned us from the unelected oligarchy back to the representatives of the people and the states with the House and the Senate. Now the alphabet bureaucrats will have to prove that congress authorized them to act before they can.

Now we the people is being restored to government. No longer van 30-40 unelected bureaucrats try to destroy an entire industry or a state unless they can prove that congress authorized them to act on its behalf on such a matter. The importance of this rule to our constitutional republic and to the common middle and working class people can not be overstated. Thank you President Trump!

every agency, btw, has authorizing , as well as appropriations legislation or it would nor exist. we now have louie gomert and lauren boebert deciding how much mad cow disease to allow on our food. .

Heaven forbid these agencies can't just act as little dictators on their own without taking it to Congress who are representatives of we the people.

congress created every agency, votes each year to fund each agency, and can call the appropriate bureaucrats to a hearing at any time.

trump, who demonstrated no ability to manage the federal (or ant other) bureaucracy, is again wrong about the "administrative state" and the requirement for regulation. his justices, by telling congress and the executive how to do their jobs, has overstepped the balance of powers,

Then I guess the majority in the senate, the House, and the president will have to settle for whatever can get 60 votes in the senate rather than trying for 51-50 all or nothing if they can’t even persuade all of their own to go along. There are bills and authorizations that are doable. The court is simply forcing the congress to actually govern, you know horse trading some things both sides want, compromise. Now that there’s no nameless unelected bureaucrats to bail them out they will have to act or get voted out be new members who will.

Trump made a far greater effort at compromise and the art of making a deal than either obama or Biden

But they are the technocrats, the “expert” class, the tools of the oligarchical elites. How dare they be made to answer to the people through our Representatives. The sheer nerve!

Trump was creating a deep state, under his thumb. Does irony and projection run that blindly amongst his flock? Rhetorical BTW.

The swap got much worse under the Trump Admin and GOP.

The deal with the Taliban was never completed by Jan 20, 2021. The Taliban was yet to be compliant enough with Trump terms. It is Biden who changed it all up on terms at timing all of which was a disaster for America. Trump didn’t leaving military equipment or civilians behind or helpful Afghans. Trump didnt free the prisoners at Bagram Air Force base or abandon the base to the Chinese. Trump didn’t abandon Kabul before we were done with the evacuation of all that we should have gotten out of there. Biden was determined to do nothing the way Trump had set it up and he humiliated the United States and got 13 American military service members killed. Let’s go Brandon…

Signed and enacted are two very obviously different things to all with an IQ above room temperature numbers. Everything I said above stands. Why did Biden wait until August to do our pullout instead of May as agreed previously? Why did Biden leave our equipment behind when Trump berated Milley for such a stupid idea while Trump was still in office? There is no defense for Biden and no sane, rational, or objective way for him or his voters to blame Trump for let’s go Brandon’s own actions.

That's sad because everything you said is either wrong or you have been ill informed.
There are a lot of reasons but the biggest two are 1) people didn't WANT to leave 2) The Trump administration made no effort to prioritize the visa's needed to get the people out and into the US.
Because it was for the Afghan's to fight the Taliban. The Afghan government fell like a house of cards faster than intelligence expected. In the long run it really doesn't matter, they don't have the ability to maintain them
You and the right will blame Biden for any and everything anyway and it has nothing to do with sanity or rationalibility.

trump's supreme appointments, sppear to have successfully removed the basis of regulation, regulation upon which consumers depend for confidence in the system and upon which industries also depend. with what do we replace emission standards and food inspections? do i have to equip my own lab to test for mercury in the tuna or salmonella on the lettuce? must i trust industry to police itself, hell, abbott would be selling their tainted baby formula right now if the fda had not stopped them?

The Supreme Court decision in the West Virginia v EPA case is arguably the most important decision of the term. It is long past time the authority of federal agencies is restricted, and Congress told to do it's damned job.
