    More nonsense! You thought wrong.

As I already explained, the last part is simply referring to a decision about whether or not they will take any action further to receiving the communication. Hence, there is nothing to be gained by omitting it - or including it, for that matter.

The reason you think it matters is because you erroneously think it means something more than this. It doesn't.

Why? Because as the letter states, there is no investigation. Before an investigation, there is a preliminary examination - a decision as to whether to act on the "communication" - or not. Hence, if there is no investigation, it means that the ICC has not decided if it will take any action further to receiving the communication. And this is the "decision" the closing line is referring to. That's it.

you simply dont seem to get it, discovery/investigation never starts before a decision is made on standing etc etc etc all courts have basically the same procedure except your personal little kangaroo court. Until then the court works solely off of the charges and evidence presented in the initial filing. No decision is made on 'anything' prior to the entry of a CASE! lol

Where did you get your law degree btw?

No failing on my part - you "don't get it" because you think the ICC system works like regular courts. It doesn't.

Now, you can call Ms Rose's word document a "case" if you like, but at the ICC, preliminary examinations, investigations and cases are three separate things.

There is no case unless and until there has been a preliminary examination AND the examination has found reason to conduct an investigation AND the investigation has found sufficient evidence to bring charges.

Yes, it is the ICC that decides whether or not to charge anyone.

None of which has happened. Hence, it is not a case.

Thus far it is merely a communication that has been entered it into their communication registry.

hardly makes it a fact. if you want to prove a fact you must first start with evidence. Just because their opinion matches yours hardly makes it a fact

false, the first thing any court does is assign a case number. that has been done.
you seem to have the misguided perception that the second a case is intered into court they get an instant discovery instant decision, sorry it does not work that way lol

"Instant discovery"? What's that got to do with anything? Discovery is simply the process whereby defence and prosecution disclose their evidence to each other.

Again, the ICC is not "any court." It works very differently from regular courts. Unlike regular courts, the ICC also does everything that happens BEFORE an alleged crime becomes a court case. In other words, the ICC is not just a court. It does all the work that precedes an alleged crime becoming a court case.

That is, the ICC investigates whether a crime has been committed. The ICC issues arrest warrants. The ICC charges people with crimes. The ICC decides if there is sufficient evidence to take the case to court. And then - and only then - does the alleged crime become a court case.

This is why "investigations" and "cases" are separate entities at the ICC. And this is why merely sending something to the ICC does NOT mean it has been entered into court. It is nowhere near becoming a court case - there are many steps that must happen first.

This is why the number on the letter is, as it states, just a "reference number" not a case number. It's not even an investigation, let alone progressed into a court case.

And if you think it ever will, you're sadly deluded. It's a sad-and-sorry smorgasbord of every crackpot covid conspiracy out there, written by someone with a law degree who is NOT a practising lawyer, but a UK version of a "sovereign citizen" who has has similarly - in the same vein of whackadoodle nutjobbery - fought the requirement that they pay taxes, and follow the rules of the road when driving.

So, it's pretty much safe to say that in Step 1 - the preliminary examination to decide if there should be an investigation opened into the matters raised in the communication - the answer will be NO.

anybody can charge anybody with a crime, the court decides standing then tries those charged(accused) of the crime. you continue to go around in circles.

You have already proven that you have no credentials to make such statements with any degree of accuracy, not to mention you have made a plethora of naked statements, not facts. Your presumptions and opinions are not facts, sorry, thats why I prefer to wait and see how it goes. I dont have a crystal ball like you do!

WRONG! Again! Only the ICC Prosecutor can bring charges.

Yes, the ICC has it's own prosecutor - just one of the ways in which the ICC is NOT like "any court" and is much MORE than a Court.

The fact that you don't even know this simple fact is yet more evidence that you're utterly clueless! So, when you think other people are wrong,it's because you have NO idea what you're talking about. You think it apples-to-apples when the ICC is an orange!

ALL criminal courts have some actor in the role as a prosecutor! :deadhorse:
Anyone can press charges against anyone.
Feel free to post your citation that the only way anyone can be charged is by a prosecutor.
