Federal appeals court says Trump is not immune from civil lawsuits over Jan. 6 Capitol attack

    The unanimous opinion from the three-judge panel for the U.S. Court of Appeals for the District of Columbia Circuit allows the cases against Trump to move forward and comes nearly a year after the judges weighed Trump's claims that he's entitled to sweeping immunity from the suits brought by a group of congressional Democrats and veteran Capitol Police officers, who seek civil damages for the harms they alleged to have suffered because of the Capitol attack.

    "The sole issue before us is whether President Trump has demonstrated an entitlement to official-act immunity for his actions leading up to and on January 6 as alleged in the complaints," Chief Judge Sri Srinivasan wrote. "We answer no, at least at this stage of the proceedings."

    The panel said that when a first-term president chooses to run for a second term, his campaign for reelection is not an official presidential act, and actions undertaken while campaigning to hold onto the presidency are done in his capacity as an office-seeker, rather than an office-holder.

    While I wish anybody suing this loser over the events of 1/6 the best of luck, I don't think that is the major takeaway here, since he's using the same basic arguement to have his DC Criminal case tossed. This should allow Chutkan to make the same ruling, being pretty much guaranteed it'll pass any appeal in this same court. I understand she might have been waiting for this ruling before making hers.... Bet she quotes it in her opinion.

    The sentence in bold is so ridiculously obvious that I cannot believe it took any court a year to put that on paper...

    shaking my head over this. We now can be sued over the actions taken by others. The fallout from DC trying to "get Trump" will be far reaching as it sets a precedent.

    Do not allow your love of all things Democrat to cloud your vision of what this does to liberty for all.

    I make no judgement on the merits of any individual lawsuit over 1/6 (and neither did the appeals court).

    Do you TRULY BELIEVE Trump was performing presidential duties between the hours of 11:57am and 1:10pm on 1/6?? That's essentially the only question the appeals court was asked to decide...

    This decision doesn't touch "liberty for all"... it's customized to one office and one man individual. such horseshit...

    I thought of a perfect example of something Trump couldn't be challenged over, because he was acting under the office of the President, even as it was one of the most treasonous things he said during his presidency (no high bar that)

    "We" could ALWAYS be sued for... anything. Except if you were a billionaire or you were high enough in government that nobody who was not a billionaire dared. NOW that has changed.

    Great. So Clinton can be sued for starting "Russian collusion" and Biden can be sued for working to hide Hunter's laptop.

    What about the agencies that helped them perpetrate these coverups? Any mention of that?

    Yes. But don't let the deposition of Hunter be public, because that would actually BOOST Joe's electoral chances as people see with their own eyes the nonsense he's up against.

    I am not devoted to Trump. I could care less. I am devoted to liberty and what was done to Trump should be done to NO AMERICAN be they Democrat or any other political persuasion .

    Hatred of anything Democrat blinds many to the precedents being set that can be used against all of us.

    I would not expect you to see that as it's all about team Democrat

    Wow .. quite the reverse is true -- it is this incessant witch hunt in a TDS fueled rage that is damaging the rule of law - and constitutional republic (democratic institutions - makes no sense)

    It is the these woke Dems obsessing over MAGA .. putting the "ends justifies the means" ideology on a raging path to getting Trump over the civic duty to God and Country .. both an immoral and irrational action . towards a collectivist Police State .. trampling on Essential liberty.

    Difference between MAGA and the Dems is that MAGA did not succeed in any of these dirty deeds accused .. the Dems did. We are now labeling general protesters / "Dissenters" .. Domestic Terrorists .. throwing out the rules of Justice Rule book along with the rule of law .. giving them the GITMO treatment .. as if the Cop City Protesters were violating the espionage act

    Here is the ruling , in a nutshell:

    “When a first-term President opts to seek a second term, his campaign to win re-election is not an official presidential act."

    That’s about as clear as it gets. And they’re 100% right.
