Federal Court Blocks Biden Rule That Forces Christian Doctors To Perform Sex Change Surgeries

A federal appeals court has permanently blocked a rule coming from the Biden administration’s Department of Health and Human Services (HHS) which demanded that religious doctors perform sex change surgeries in violation of their beliefs.

The eighth circuit’s decision comes months after the fifth circuit issued an opinion in August 2022 in Texas that struck down a reading of the Affordable Care Act which would require every doctor to provide sex change surgeries regardless of religious conviction. Friday’s decision affirmed this August opinion…

…“We agree with these courts and therefore conclude that the district court correctly held that ‘intrusion upon the Catholic Plaintiffs’ exercise of religion is sufficient to show irreparable harm,'” the eight circuit wrote in its decision…


…“The federal government has no business forcing doctors to violate their consciences or perform controversial procedures that could permanently harm their patients,” Luke Goodrich, VP and senior counsel at Becket Law, who represented the plaintiffs in the case, said in a press release.

Goodrich added that the ruling would establish a precedent in favor of religious liberty for future cases involving the issue of doctors performing sex change surgeries.

“Today’s victory sets an important precedent that religious healthcare professionals are free to practice medicine in accordance with their consciences and experienced professional judgment,” Goodrich said. “The government’s attempt to force doctors to go against their consciences was bad for patients, bad for doctors, and bad for religious liberty.”…

This is great news for religious liberty. The free exercise clause of the constitution is not to be causally overturned by a presidential decree. Religious believers should never be compelled to violate their religious beliefs in order to pursue any part of their livelihood.

 

The regime has no shot at overturning this ruling on appeal.

There is a "rule" that "forces" doctors to perform some surgery?

 

Kinda — Section 1557 of the ACA placed gender identity and sexual orientation to the provision prohibiting discrimination in healthcare settings. It was repealed under trump and reinstated under Biden.

While gender affirming surgery wasn’t specifically the intent, it was impacted.

I don’t necessarily disagree with the court — doctors should not have to preform procedures they do not believe is necessary but by that same coin they should be able to provide procedures they have deemed necessary with consent of the patient — including abortion.

The same people screaming this is a win for “freedom” are typically also for abortion bans and gender affirmative surgery in general. Not being giant hypocrites aren’t really a strong suit of people that believe in magical sky beings.

 

Once again, the court slaps down the fascist in chief.

Who would want a doctor performing a surgery on them that the doctor does not want to perform and has never performed before? I have seen enough surgical injuries to never have a surgery from anybody other than a specialist. It is never in the patient's interest to be operated on by a reluctant doctor. This was an awful order by the President on multiple levels. It exceeds his authority, it places patients in harms way and removes freedoms from the people.

 

Is this a real thing? Like there are surgeons who say wait, 2,000 years ago there was some guy, who probably never existed, who claimed to be the son of some god, who told folks to.love and accept everyone, so therefore I cannot perform a gender reassignment surgery?

 

It sure is. I'm sure they'll be able to find a healthcare provider who will perform their sex change operation. Sort of like a Gay couple finding a baker who'd be happy to make a cake for their wedding.

Would you like see to the AFTER pictures from gender reassignment surgeries? The Hippocratic oath binds a doctor to first do no harm. Hacking off the perfectly healthy sexual organs breaks that oath. No God needed to understand this. Fix the person's brain, never butcher their body. The suicide rates for post-op patients do not lie.

it goes beyond religious liberty. In a free country no one should be forced to do anything. What liberal democrats are all about is telling us what we must do and what we can’t do. Libs call that freedom, so does North Korea’s rocket man.

 

Since you brought God into it, why would God put a kid in the wrong body? If he exists, he didn’t. The kid was brainwashed by libs wanting that kid to be in the wrong body.

After a kid switches bodies, do libs ever tell them they’re in the wrong body and try to get them to swap again or do they stop there and move on to the next kid? I mean, it seems the agenda is to get kids to think they’re something they’re not, which means the left can have an endless number of gender swaps with just one kid before that kid commits suicide.

And where are all these wrong bodied kids coming from? In all my years I never saw a single one. Now they’re everywhere.

 

Not sure what Christian has to do with it. Nobody should be forced to do anything for anybody. Every time someone from death row needs life saving support, the entirely of the medical community should be able to refuse. Nobody should be forced to color my hair purple or create a website that praises the sea snake.

So many of you are in love with government. Well, this is what you get. You need government to force people to do stuff and then more government to listen to reasons government shouldn’t be forcing you to do stuff.

Strange thing about this is Biden wants to force doctors to perform medical procedures on people who don’t want to perform them, but there is no rule about performing medical procedures if the patient has no insurance and can’t afford them. What is the first question you’re asked when you go to a doctor? Insurance card please and your co-pay is…. If you can’t pay then hit the road.
