Amend that to, a Judge's personal beliefs are irrelevant, a Judge must believe in the Legal system and that it does work and guarantees Justice for all through Jurisprudence.

But in the OP you said "anyone should be able to get married that can procreate...end of story." so you need to find a way to refine that definition so you do not include father and daughter. And you need to find a way to exclude lesbians (who will be able to procreate without a man with new fertility techniques) without excluding male+female couples who need to use fertility techniques to procreate. It sounds like it will become a rather complicated algorithm. Also, most statisticians recognize that correlation does not always represent causation. The Bible actually explains why Sodom was destroyed in Ezekiel 16:49-50 (NIV): "'Now this was the sin of your sister Sodom: She and her daughters were arrogant, overfed and unconcerned; they did not help the poor and needy. They were haughty and did detestable things before me. Therefore I did away with them as you have seen." You probably assume that homosexuality was included in those "detestable things" but clearly God did not consider it important enough to mention directly.

Please supply evidence to back up your claim. Considering that gays only represent about 3-4% of the population of a country containing 320 million people, I don't think they are going to make a difference in the US birthrate. Of course, they could help in the adoption of the 100,000 orphans in the US.
