Senators agree on path to legal status for illegal immigrants
March 11, 2013 - Senators crafting a bipartisan overhaul of immigration laws agree on a path to legal status, aides say, but other hurdles remain.

Eight senators who have spent weeks trying to write a bipartisan bill to overhaul immigration laws have privately agreed on the most contentious part of the draft how to offer legal status to the nation's 11 million illegal immigrants. According to aides familiar with the closed-door negotiations, the bill would require illegal immigrants to register with Homeland Security Department authorities, file federal income taxes for their time in America and pay a still-to-be-determined fine. They also must have a clean law enforcement record.

Once granted probationary legal status, immigrants would be allowed to work but would be barred from receiving federal public benefits, including food stamps, family cash assistance, Medicaid and unemployment insurance. The group's current draft is largely in line with President Obama's call to set a pathway to earned citizenship as part of a broader immigration reform package, as well as with recent efforts by prominent Republican lawmakers to resolve an issue that hurt GOP candidates in November's election.

Though the draft is a long way from becoming law, immigration advocates expressed guarded optimism about a possible breakthrough. "Nine months ago, people would have thought you were nuts to say that four Republicans and four Democrats were working on a way to legalize 11 million people," said Angela Kelley, an immigration expert at the Center for American Progress, a think tank with close ties to the White House. "It's a Rubik's Cube, but more sides are matching in color than ever before. That's significant."

Still undecided is how long illegal immigrants would need to wait before they could apply for permanent resident status and eventually become citizens. The delay for a green card probably would be 10 years or longer, the aides said. Also unresolved are such politically charged topics as how many visas to issue to high-tech specialists and other guest workers; how to keep track of when visitors leave the country; and how to pay for more Border Patrol officers, fencing and other security measures in an era of shrinking budgets, the aides said.

Sen. Chuck Schumer on Border Security: We Certainly Need More Drones
April 23, 2013 Sen. Chuck Schumer (D-N.Y.) said at a Senate Judiciary hearing on the Immigration Modernization Act, a bill he helped author, that visiting the U.S. southern border was a revelation and more drones were needed to secure it.

Look, I went to the border, Schumer said on Tuesday. It was a revelation to me. Schumers trip to Arizona was with Republican Sens. Jeff Flake and John McCain, both of Arizona, and Sen. Michael Bennet (D-Colo.) all part of the so-called Gang of Eight that unveiled the legislation last week.

Describing the surveillance technology amazing, Schumer called for increasing the number of drones along the U.S. border with Mexico. If you use air particularly drones you can actually figure out where the people are going and get force them, apprehend them 20, 30, 40, 50 miles inland, Schumer said. And the drones have the ability to follow that. We certainly need more drones. We need more air. The people on the border made that clear to us, and it should increase the effectiveness rate dramatically, in my opinion at least. Do you disagree? Schumer asked the sole witness at the hearing, Homeland Security Secretary Janet Napolitano.

Napolitano responded to Schumer by referring to the denominator, or part of a mathematical formula DHS uses to measure the effectiveness of border security efforts. Well, I wont disagree, and the technology, I think, as its implemented will give us more confidence in the denominator, which has always been one of the major problems in calculating the effectiveness, Napolitano said.

The 844-page immigration bill will, as currently written, provide a pathway to citizenship for the estimated 11 million people who are in the United States illegally.

We have a very real problem, Sessions said. In December of 2012 a few months ago a survey of federal agencies showed that morale of ICE employees had dropped in rankings to 279th out of 291 federal agencies. Were you aware that morale at ICE has plummeted? Sessions asked. Oh yes, Napolitano said. And, in fact, employee morale is a real concern of mine. And its not just with ICE, its throughout the department, Napolitano said.

In June of 2010, the National Immigration and Customs Enforcement Council, ICEs labor union, sent a Vote of No Confidence letter to ICE leadership. On June 11, 2010, the National Immigration and Customs Enforcement Council and its constituent local representatives from around the nation, acting on behalf of approximately 7,000 ICE officers and employees from the ICE Office of Enforcement and Removal Operations (ERO), cast a unanimous Vote of No Confidence in the Director of Immigration and Customs Enforcement (ICE), John Morton, and the Assistant Director of the ICE Office of Detention Policy and Planning, (ODPP), Phyllis Coven, the letter stated.

As reported earlier by CNSNews.com, a 2011 memorandum issued by Morton directed prosecutorial discretion for enforcing federal immigration law guidance that has come under sharp criticism , including from the ICE union and its president, Chris Crane. Crane testified before the same committee in February about ICE agents being preventing from doing their job. I think most Americans assume that ICE agents and officers are empowered by the government to enforce the law, Crane said at the hearing. Nothing could be further from the truth." With 11 million illegal aliens in the U.S., ICE agents are now prohibited from arresting illegal aliens solely on charges of illegal entry or VISA overstay the two most frequently violated sections of U.S. immigration law, Crane said.

The hearing today, Apr. 22, centered around the 844-page Immigration Modernization Act, proposed by the Gang of Eight Republicans and Democrats that, in part, offers a pathway to citizenship to the estimated 11 million people who are in the United States illegally.

By the time the woman perished, she had probably slogged 25 miles (40 kilometers) through dry ranch lands in her quest to enter the United States. She was found just feet from a highway where she might have been picked up and taken to Houston with other migrants making the same journey. Not long ago, her body would have been taken to a funeral home for a cursory attempt at identification, then buried in this town an hour north of the Mexico border under a sign reading "unknown female."

Her death, probably from hypothermia, is part of a mounting body count that has overwhelmed sparsely populated Brooks County, providing further evidence that immigrants are shifting their migration routes away from the well-worn paths into Arizona and instead crossing into deep southern Texas. The changing patterns have put an extra burden on local governments with limited experience in such matters and even fewer financial resources. "There are some counties that have the economic wherewithal to take on these issues, and there are other counties that just don't have any money, so that puts them into a real bad bind," said Raquel Rubio Goldsmith, coordinator of the Binational Migration Institute at the University of Arizona, which researches immigration issues.

But Brooks County is trying to step up to the challenge. Now, all newly recovered bodies and skeletal remains of suspected immigrants will travel 90 miles (145 kilometers) to nearby Webb County for autopsies, DNA sampling and more intense efforts at identification. It's a monumental step for Brooks County, population just over 7,100, where on a recent morning the chief deputy mopped the floors of the sheriff's office himself. He will also be making the weekly trips to deliver corpses to the medical examiner in Laredo. The county handled 129 bodies last year, which Judge Raul Ramirez, the county's top administrator, says blew a hole in the budget. And even though he and most other local officials see illegal immigration as a federal problem, federal money has not followed.

Last year, Brooks County trailed only Pima County, Arizona, in the number of immigrant bodies recovered and they already have 76 this year. Nearly a million people live in Pima County, and the 171 bodies found in 2012 were consistent with annual totals dating back to 2004, according to a report by the migration institute. Brooks County, on the other hand, averaged 50 to 60 dead before last year, but Border Patrol apprehensions in the area have soared.
