Judge Cannon rejects Trump’s attack on the Espionage Act

    In a nutshell, Judge Aileen Cannon rejected Donald Trump's challenge to the Espionage Act and expressed doubt about his claim of protection under the Presidential Records Act. But, she ruled 'without prejudice', and practically invited defense to bring up the case dismissal issue during jury selection (jury instruction? Not real clear on it) at trial.

    I get the idea she is walking a fine line between not being overruled by the 11th circuit for egregious mistakes, and keeping Trump happy. She couldn't possibly dismiss the case, that would have triggered an appeal by Smith and a smack down by the 11th circuit, and this will avoid it, but, at the same time, she appears to be trying her best to try and keep Trump and defense counsel happy, ostensibly hoping defense counsel explains to Trump that this is the best she could do. It is the best she could have done to help Trump, because it won't be appealed, and she ruled 'without prejudice' (I doubt other judges would have, but, hey, what do I know? ).

    FORT PIERCE, Fla. — U.S. District Judge Aileen M. Cannon on Thursday shot down one of Donald Trump’s bids to toss out the charges against him for allegedly mishandling classified documents, rejecting his claims that the Espionage Act was unfairly vague when used against a former president.

    In a brief written order, Cannon said some of Trump’s arguments warrant “serious consideration” but added it was too early to dismiss charges based on disagreements over the definition of some terms used in the Espionage Act. She did say Trump could raise the issue later “in connection with jury-instruction briefing and/or other appropriate motions.”
