Judicial Watch Sues CIA and DOJ for Communications of Eric Ciaramella

    "Judicial Watch announced today [Dec. 26th.] that it filed Freedom of Information Act (FOIA) lawsuits against both the DOJ and CIA for communications of CIA employee Eric Ciaramella, who reportedly worked on Ukraine issues while on detail to both the Obama and Trump White Houses."

    We have to get to the bottom of these continued assaults on our government. The revelations of corruption just keep going deeper and deeper.

    I don't know if Ciaramella is the hoaxblower, but it sure does look like he's involved up to his eyeballs.

    I can remember when the left were opposed to this kind of corruption. Suddenly, it's not so much. Now, half of the country is supporting this stuff. I fear that there isn't enough popular support to rid the nation of the corruptocrats.

    I don't know if he does, for sure. He looks like a duck, though.

    Somebody, whoever the hoaxblower is, conspired with Schiff's staff to concoct another hoax.

    Yes. The 2019 Politifact Lie of the Year is Trump's claim, "Nearly everything the WB said is a lie." And it is explicitly their lie of the year because nearly every aspect has been corroborated.

    You do not understand how the espionage act works.

    I want to be clear you believe EVERY claim the complainer listed was true. The leaking of classified information by whoever gave it to Ciaramella. What was Ciaramella's need to know? Who did he tell it to in Schiffs office and did they have the clearence and need to know?

    JW is clearly comprised of people of the right, but they have integrity and try to ferret out corruption and banana republic behavior. So you gotta support them if you have good principles.


    Foolish partisans see them as an enemy. But that makes partisans the enemy of our form of govt and constitution. We dont need these partisans at all. Too irresponsible and dangerous.

    The suit will be tossed. In the FOIA world, there is this thing known as the Glomar response. Basically, whenever responding to a FOIA request could subject someone to retribution or embarrassment, the government can respond that it can neither confirm nor deny the existence of the requested documents. If that response is challenged in court, as is the case here, the judge will get to review the documents to decide for himself whether glomar protection is warranted.

    I love how Judicial Watch has basically used FOIA to get the information that the government is not willing to give out. I don't know how much they can get in this case, but I hope it's enough to make Adam Schifty Schiff freak out again.

    Please describe how the Glomar response applies to this situation especially since we all know who he is and there has been no retribution? I'm sure all the Judges know that. Please be specific.

    I will take a stab at the argument.

    First, we do not "all know who he is." A very small group of right wing publications have accused him of being the whistleblower. There are zero major news publications and the overwhelming amount of public figures who have even said his name, let alone accuse him of being the whistleblower.

    Second, releasing his information based on those very, very few accusations (note: his name was never mentioned by any fact witness during the impeachment trial) would be tantamount to engaging in an effort to punish Ciamarella simply because he got caught up in a right wing campaign designed to smear the whistleblower.

    Third, if he is the whistleblower, then he is entitled to additional protections from the government and releasing his communications simply to satisfy the right wing's desire to punish the whistleblower is retribution and violates federal whistleblower protection laws.
