Or maybe the states attorneys in all these states so far have done a (*)(*)(*)(*)-poor job defending marriage bans? The will of the people has NEVER in the history of the United States been the sole dictator of public policy, for good reason. Most Americans are not intelligent enough to have an opinion on an issue like gay marriage (which doesn't effect them at all) so why should they decide the civil rights of an entire sector of society that has for years suffered abuse and discrimination?
It's because they don't understand the constitution. Or don't believe in it, which is more disturbing.

Tyrants take rights from people. Gay marriage does not take rights from anyone. You can whine all day and night about it..but gay marriage in no way at all affects your rights.
I wonder if this point is too subtle for some people here. The discrimination amendments served a clear and present political interest, in all the states where the politicians happily pandered to the bigot vote. But there is no STATE interest, which is something different.
might happen by end of next year. too many states are overturning laws for SCOTUS to avoid making a sweeping ruling at this point one way or another. they already ruled Federal govt has to recognize same sex marriage in states where it is legal, next step is banning restrictions on marriage based on gender
