    What constitutional requirement did the Senate fail to do?

    They told us that since he had no chance of being confirmed, they weren't going to waste the time and money just to go through the motions. That is how they did their "advise" part of the process.

    Obama NOMINATED Garland, that's all a President does, then it's up to the Senate. The Constitution does not say "then shall the Senate confirm the nominee". The Constitution says they will decide to confirm or not confirm and no vote is required. Obama was free to nominate someone that he could work with the Senate to get confirmed, he choose not to so the seat remained open.

    What criteria. With Garland there was a President and an opposition Senate. With Barrett, it's Barrett, it was a President with a complimentary Senate. And of course the Republicans had learned how hardball the Democrats would play with Kavanaugh so they told the Democrats to take a hike............that's politics.

    You maybe gained one in the Senate not taking as was being bragged would happen and last number I heard was lost double digit in the House when the bragging was a 10 seat pickup. No changes in the state legislatures of governors. There was supposed to be the HUGE blue wave refutiation of Trump and the Republicans, it didn't happen it's been neck and neck.
