Trump ramps up attacks on judges, sparking concerns as criminal trial nears

Former president Donald Trump is ramping up efforts to disparage judges overseeing his criminal and civil cases — reprising a long-standing strategy as a high-profile trial draws near and prompting growing concerns from legal experts and an expanded gag order late Monday.

The presumptive Republican presidential nominee’s approach, part of a broader election-year attempt to portray the judicial system as weaponized against him, was evident in a slew of attacks over the weekend. Such broadsides, which Trump has often lobbed without evidence for his claims, have raised worries about the safety of judges and threaten to undermine faith in the court system, some legal experts said Monday.

Trump’s personal attacks against the daughter of the New York judge overseeing a hush money case prompted the judge to expand an existing gag order to include his family and the district attorney’s family.

‘It’s clearly strategic’: Why Trump kept attacking judges’ families

After Trump spent several days denigrating the adult daughter of Justice Juan Merchan, the judge overseeing Trump’s Manhattan criminal case, Merchan issued an expanded gag order barring Trump from attacking the judge’s own family. Merchan also expanded the gag to cover the family of the lead prosecutor, Manhattan District Attorney Alvin Bragg.

“The average observer, must now, after hearing Defendant’s recent attacks, draw the conclusion that if they become involved in these proceedings, even tangentially, they should worry not only for themselves, but for their loved ones as well,” Merchan wrote. “Such concerns will undoubtedly interfere with the fair administration of justice and constitutes a direct attack on the Rule of Law itself.”

Trump Media is ‘a scam’ and people buying its stock are ‘dopes,’ Barry Diller says

Trump Media is “a scam,” and people buying its high-flying stock are “dopes,” IAC and Expedia Chairman Barry Diller said Thursday in a scathing takedown of the social media company whose majority shareholder is former President Donald Trump.

“I mean, it’s ridiculous,” Diller said on CNBC’s “Squawk Box” when asked about Trump Media. “The company has no revenue.”

“It’s a scam, just like everything he’s ever been involved in is some sort of con,” he said of Trump.

Trump’s Electoral College Mischief In Nebraska Fails

Republicans in the Nebraska legislature failed last night to pass a bill that would have awarded the state’s electoral votes on a winner-takes-all basis – a change that would likely cost Joe Biden one vote in what could be a close 2024 election.

The Trump-backed move to change the rules of the game in Nebraska had been dormant for some time before it suddenly ramped up this week at the urging of right-wing gadfly Charlie Kirk.

The legislative session doesn’t end until April 18, so the measure could be brought back up for a vote again. But the procedural mechanics and the way it failed last night suggest this may be the end of the road for it.

Reps. Andy Biggs, Paul Gosar subpoenaed in Arizona probe of Trump fake electors

Arizona investigators probing Republicans’ efforts to overturn the state’s 2020 election results have subpoenaed two members of Congress who were among Donald Trump’s closest Capitol Hill allies in the scheme.

The subpoenas to Reps. Andy Biggs and Paul Gosar, which have not previously been reported, ordered the two Arizona Republicans to testify before a grand jury.

Judge rejects Trump’s effort to dismiss Georgia charges on First Amendment grounds

The judge presiding over Donald Trump’s criminal case in Georgia denied his bid to throw out the case on First Amendment grounds, rejecting the former president’s longshot argument that the entire case is an attempt to criminalize his political speech.

“The State has alleged more than mere expressions of a political nature,” Fulton County Superior Court Judge Scott McAfee wrote in a 14-page ruling on Thursday.

Jeffrey Clark’s bid to aid Trump election scheme violated attorney rules, DC Bar panel finds

A disciplinary panel in Washington has found that Jeffrey Clark, a former high-ranking Justice Department official, violated ethics rules for lawyers in his attempt to aid Donald Trump’s bid to subvert the 2020 election.

The three-member disciplinary committee determined Thursday that Clark’s campaign to pressure Justice Department leaders to help upend the transfer of power to Joe Biden violated his duties as an attorney.

Trump subpoena to NBC over Stormy Daniels documentary blocked by judge

NEW YORK, April 5 (Reuters) - Donald Trump's subpoena to Comcast-owned (CMCSA.O), opens new tab NBCUniversal for material related to a recent documentary about porn star Stormy Daniels was blocked on Friday by the judge overseeing the former U.S. president's April 15 criminal trial.
Justice Juan Merchan said Trump's claim that Daniels and NBC conspired to release the film close to the trial to damage him was unsupported.
"His subpoena and the demands therein are the very definition of a fishing expedition," the judge wrote in a court order.

New York Attorney General Questions Trump’s $175 Million Bond Deal

Now, however, Ms. James is raising questions that could imperil the deal with Knight, which is owned by Don Hankey, a billionaire who made his fortune with subprime loans. And the judge in the case, Arthur F. Engoron, has tentatively scheduled a hearing for April 22 to discuss the bond.

In a court filing on Thursday, Ms. James noted that Knight was not registered to issue appeal bonds in New York, and so she demanded that the company or Mr. Trump’s lawyers file paperwork to “justify” the bond within 10 days. Ms. James is seeking to clarify whether Knight, which had never posted a similar court bond before aiding Mr. Trump, is financially capable of fulfilling its obligation to pay the $175 million if Mr. Trump defaults.

Even if Knight lacks the funds itself, the company should be able to tap the collateral Mr. Trump pledged.

In an interview this week, Mr. Hankey said that Mr. Trump pledged $175 million in cash as collateral that was being handled by a brokerage firm. Mr. Trump, in the meantime, is able to earn interest on the money.

Appeals Court Denies Another Trump Attempt to Delay Trial

One week before Donald J. Trump is set to face a criminal trial in Manhattan, an appeals court judge on Monday rejected his effort to pause the case and move it to a different location.

The judge, Lizbeth Gonzalez, issued the decision Monday afternoon after hearing arguments from Mr. Trump’s lawyers and lawyers from the Manhattan district attorney’s office, which has accused the former president of falsifying records to cover up a sex scandal.

For weeks, Mr. Trump has sought to delay the trial, the first prosecution of a former U.S. president, and possibly the only one of Mr. Trump’s four criminal cases to make it to trial this year.

Mr. Trump’s attempt to move the case out of Manhattan was not the only delay strategy he deployed on Monday. In a separate proceeding, he indicated that he planned to file an unusual type of lawsuit against the judge overseeing the case, Juan M. Merchan.

As the date for the start of his first criminal trial approaches you can smell the fear.

Prosecutors Ask Supreme Court to Reject Trump’s Immunity Claim in Election Case

Jack Smith, the special counsel prosecuting former President Donald J. Trump on charges of plotting to overturn the 2020 election, urged the Supreme Court on Monday to reject Mr. Trump’s claim that he is immune from prosecution.

“The president’s constitutional duty to take care that the laws be faithfully executed does not entail a general right to violate them,” Mr. Smith wrote.

The filing was Mr. Smith’s main submission in the case, which will be argued on April 25.

He wrote that the novelty of the case underscored its gravity.

“The absence of any prosecutions of former presidents until this case does not reflect the understanding that presidents are immune from criminal liability,” Mr. Smith wrote. “It instead underscores the unprecedented nature of petitioner’s alleged conduct.”

Former Trump executive Allen Weisselberg sentenced to five months in jail for perjury

Former Trump Organization Chief Financial Officer Allen Weisselberg on Wednesday was sentenced to five months in jail for lying under oath during the civil business fraud trial of Donald Trump.

Weisselberg, 76, declined to speak before the judge in a brief hearing in Manhattan criminal court.

That sentence would put Weisselberg behind bars for the second time in two years in connection with his work for Trump’s company. He spent three months in jail on Rikers Island last year after pleading guilty to helping orchestrate a tax fraud scheme at the business.

The tax and perjury charges were brought by the office of Manhattan District Attorney Alvin Bragg, who is prosecuting Trump on charges of falsifying business records as part of a hush money scheme.

Appeals court judge rejects Trump's effort to delay his hush money trial as he appeals a gag order

A New York appeals court judge Tuesday denied Donald Trump's bid to halt his hush money trial while he appeals a gag order, a ruling that came less than 24 hours after another judge rejected the former president's request to delay his impending criminal trial on other grounds.

Tuesday's ruling came roughly one hour after Trump attorney Emil Bove argued that his client is entitled to a stay of the proceedings while he challenges the "unconstitutional" partial gag order Judge Juan Merchan handed down against Trump last month and expanded days later.

Bove contended the gag order — which prohibits Trump from bashing witnesses, individual prosecutors, court staff and their relatives, the judge's relatives, and jurors and potential jurors — means his client can't comment on publicly filed motions and that it violates the former president's Sixth and First Amendment rights.

Trump Loses His Third Try in a Week to Delay Manhattan Trial

Lawyers for Donald J. Trump have spent this week seeking to stave off the former president’s trial on charges that he covered up a sex scandal.

They tried again Wednesday. Again, they failed.

In Mr. Trump’s latest last-minute bid to delay a trial that starts Monday, he filed a civil action in an appeals court against the judge in the case, Juan M. Merchan. It sought to delay the trial while the appeals court reconsidered several of the judge’s rulings.

A single appellate court judge, Ellen Gesmer, promptly rejected Mr. Trump’s request. Mr. Trump can now have his action heard by a full panel of five appellate court judges, but it would be nearly impossible for the court to act before the trial begins.

The episode underscored Mr. Trump’s increasing desperation to delay the trial, and his scattershot approach to doing so.

'Florida blocks heat protections for workers right before summer'
    Source: NPR

    April 12, 2024 2:07 PM ET

"Florida Governor Ron DeSantis has signed a law that prevents cities or counties from creating protections for workers who labor in the state's often extreme and dangerous heat. Two million people in Florida, from construction to agriculture, work outside in often humid, blazing heat.

For years, many of them have asked for rules to protect them from heat: paid rest breaks, water, and access to shade when temperatures soar. After years of negotiations, such rules were on the agenda in Miami-Dade County, home to an estimated 300,000 outdoor workers.

    snip"
"It's outrageous that the state legislature will override the elected officials of Miami Dade or other counties that really recognize the importance of protecting that community of workers," says David Michaels, an epidemiologist at George Washington University and a former administrator at the federal Occupational Health and Safety Administration (OSHA).'

Trump is about to face trial on criminal hush money charges. Here’s what to know

Donald Trump has used every legal tool at his disposal to try to dismiss, diminish or delay the four active criminal cases against him.

But on Monday, barring a last-minute court intervention, Trump will become the first former president ever to be tried on felony charges.

The trial in New York Supreme Court centers on allegations that Trump falsified business records as part of a scheme to conceal a $130,000 hush money payment in 2016 to porn star Stormy Daniels, who says she had an extramarital affair with Trump years earlier.

Manhattan District Attorney Alvin Bragg accuses Trump of using a “catch and kill” tactic to hide damaging information from voters ahead of the 2016 presidential election.

    https://www.cnbc.com/2024/04/11/trump-to-face-trial-criminal-hush-money-charges-what-to-know.html

And so the whole sorted affair begins. Let's see if Don's erratic, uncontrollable impulses get the better of him regarding the gag order. The same impulses making him unfit to be prez.

Come For Jury Selection, Stay For Contempt Proceedings

Before jury selection even began in the first-ever criminal trial of a former president, prosecutors sought to hold Donald Trump in contempt of court for violating the gag order imposed on him in the hush-money case.

On social media in the days before trial, Trump continued to attack witnesses in the case, including key witness Michael Cohen, Trump’s former fixer.

Prosecutors want Trump sanctioned $3,000 for the violation and warned that further violations could send him to jail for the duration of the trial.

The trial judge said he would enter a show cause order as to why Trump should not be held in contempt and set arguments on the matter for April 23. The contempt proceeding will happen in parallel with the trial.

At some point a judge is going to have to enforce one of the gag orders.

Flurry Of Unusual New Developments In Trump Hush Money Trial

NEW YORK — Prosecutors with the Manhattan DA’s Office accused Donald Trump of violating his gag order seven more times on Thursday morning amid a series of new developments in the trial which resulted in two already-seated jurors being dismissed.

Trump Accused of Violating Gag Order
Prosecutor Joshua Steinglass said that several social media posts Trump had made about Michael Cohen had crossed the line, and added that another post — in which Trump quoted Fox News host Jesse Watters as accusing “liberal activists” of trying to sneak onto the jury — was “disturbing.”

It’s a pattern of behavior for Trump, who Judge Juan Merchan accused on Tuesday of muttering at a juror 12 feet in front of him.

Trump attorney Todd Blanche defended the posts as “responding to political attacks,” and feigned confusion over whether the gag order applied to social media posts that repost comments made by others.
