SNIP Lawyers for former President Donald Trump are asking Georgia's highest court to prevent the district attorney who has been investigating his actions in the wake of the 2020 election from prosecuting him and to throw out a special grand jury report that is part of the inquiry. Trump's Georgia legal team on Friday filed similar petitions in the Georgia Supreme Court and Fulton County Superior Court naming Willis and Fulton County Superior Court Judge Robert McBurney, who oversaw the special grand jury, as respondents. A spokesperson for Willis declined to comment. McBurney did not immediately respond to an email seeking comment. In a previous filing in March, Trump's lawyers made similar requests and asked that a judge other than McBurney hear their claims. Willis rejected the arguments as being without merit. McBurney kept the case and has yet to rule on the Trump team's requests. ENDSNIP https://abcnews.go.com/US/wireStory/trump-asks-top-georgia-court-disqualify-election-probe-101294210 Losers are gonna lose..... It's like death and taxes.... The Supreme Court will refuse the case and this basic request was already made in Fulton, and ignored. Even Mary (of Hail Mary fame) wouldn't try something this desperate...it's like trying to extinguish a lava slide with a water gun.... It's almost like the lawyers think Mango will be indicted in Georgia at some point??
And if tried and convicted, no *get out of jail free* card will be issued, as this would be a state conviction, not federal. Oh yeah, also ...................... The hits just keep on coming. I would think that a completely innocent (and perfect!) person would be highly anticipating a trial to clear their name.
In a Normal world sure. But we live in corrupt times with CJ systems attacking people based on politics. So no innocent person can truly feel safe.
This isn't even a lawsuit.... just a petition for relief, much as somebody on death row submits 2 days before... with equal chance of success... Been a long summer.... Fani has to be raring to go by now... Strange system that stretched it out this long, IMHO...
Simply more delay tactics, even the strategic wait for this filing is part of the delay justice tactic....it's his right and a privilige of his supporters monies and it continues to just day trade on time.
I don't see how either filing prevents DA Willis from moving forward on her schedule... If the GA Supreme Court actually rules on the petition (they won't), it might, but until they do, it's a non-issue... Just flailing (and failing) from an increasingly desperate man... But I will add any negative rulings to his incredible record of losing...
The last "win" that guy had was when he was determined to be a sexual abuser, instead of a flat out rapist. The Diet Coke must have flowed like wine that day....
CHUTZPAH: Georgia Prosecutors File Challenge to Block Law That Holds Prosecutors Accountable. 'The law, which requires district attorneys to look at every case for probable cause and prevents the blanket dismissal of cases, took effect on July 1. The law also set up a commission that has the power to discipline or remove prosecutors who don’t prosecutes crimes thoroughly and fairly.' 'Spearheading the effort is DeKalb County District Attorney Sherry “I Can’t Prosecute Domestic Terrorists” Boston, who has twice recused her office from prosecuting Antifa thugs who have targeted the future site of a public safety training center for the City of Atlanta.' '“All Georgians deserve to be safe, and all crime victims deserve justice,” Carr also tweeted. “Like everyone else, DAs who choose to violate their oaths of office are not immune from accountability, and we will vigorously defend this law in court.”' Trump's likely right about the prosecutor on this Grand Jury.
Judge in that case said he’s definitely a rapist. https://www.washingtonpost.com/politics/2023/07/19/trump-carroll-judge-rape/
Oh, I agree with that, but the wacky antiquated NY statute allowed the jury to say otherwise. I wonder if EJC's 2nd case in January will make a different determination?? Plus Mo Money!
Former Georgia Lt. Gov. Geoff Duncan subpoenaed in Fulton's Trump probe Source: Atlanta Journal-Constitution 'Former Lt. Gov. Geoff Duncan has received a subpoena to testify as a witness before a Fulton County grand jury that could deliver indictments against former President Donald Trump and his allies this month. Duncan told The Atlanta Journal-Constitution on Monday that he has yet to receive a date to meet with grand jurors, but he added on social media that he would “share the facts as I know them around this investigation in hopes of figuring out what really happened.” That’s viewed as an indication that he will agree to testify — something he didn’t initially do when he received a subpoea last year to speak to a separate special grand jury that probed whether Trump violated Georgia law with his attempt to overturn his 2020 election defeat. Duncan and several other Republican elected officials then challenged their subpoenas in court, arguing they’re immune from testifying due to legislative privilege.' Geoff Duncan snip: 'Duncan was inaugurated lieutenant governor on January 14, 2019.[16] On December 6, 2020, Duncan and Governor Brian Kemp put out a joint statement explaining that calling a joint session of the Georgia General Assembly to appoint their own electors to send to the United States Electoral College would be unconstitutional.[17] Following unsuccessful efforts to overturn the election of Democratic candidate Joe Biden in the 2020 presidential election, in March 2021 Georgia Republicans enacted the controversial Election Integrity Act of 2021 that imposed new restrictions on voting. Days later, Duncan said during a CNN interview that momentum for the legislation grew from "the fallout from the ten weeks of misinformation that flew in from former President Donald Trump. I went back over the weekend to really look at where this really started to gain momentum in the legislature, and it was when Rudy Giuliani showed up in a couple of committee rooms and spent hours spreading misinformation and sowing doubt across, you know, hours of testimony."[18] In April 2021, Duncan's chief of staff stated that he was unlikely to run for a second term, after he openly contradicted false claims of election fraud in the 2020 presidential election. His chief of staff added that Duncan has yet to make a final decision about whether to run again in 2022.[19] On May 17, 2021, Duncan announced that he would not be seeking a second term.[20] https://en.wikipedia.org/wiki/Geoff_Duncan
Correct me if I'm wrong, but isn't Duncan a registered R?? (P.S. I'm not wrong.. just keeping with the witness pattern)
. Looks like there's no restrictions this time that he had under the Special Grand Jury last July. "Duncan and several other Republican elected officials then challenged their subpoenas in court, arguing they’re immune from testifying due to legislative privilege. Fulton Superior Judge Robert McBurney disagreed and instead set down guidelines for what prosecutors were and were not able to ask lawmakers when they testified'. The judge said the district attorney could not ask about anything related to the conversations Duncan and other legislators had with one another, nor could they inquire about their motivations.'
