    CNN —
Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday.

The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. The former president had argued that the conduct Smith charged him over was part of his official duties as president and therefore shield him from criminal liability.

Major blow to the rights attempt at an imperial presidency. It was always a crazy notion. What was amazing was how he got people who hate the federal govt, to go along with this huge power grab.

His lawyers have also asserted that because Trump was acquitted by the Senate during impeachment proceedings, he is protected by double jeopardy and cannot be charged by the Justice Department for the same conduct.

Imo this was one of the dopier arguments he tried. Nobody would ever impeach a president for actual crimes if that’s how it worked.

When this (inevitably) get to the SCOTUS, we will see how Trump's claim of "immunity" works...
We will also see how utterly in the tank the current S. Court is for the GOP and Trump...

Glad to read this. It was an insane position to push someone is above the law as Trump suggests. With that aside, time to start the trial.

Interesting criticism considering the left is more authoritarian than Trump hopes to be.

    Exactly...
The "Double Jeopardy" angle is a complete non-starter.

Do they even want to rule on it? They had a chance to skip the appeals court and refused. Maybe they let the ruling stand

I thought we were the ones not enforcing the law, defunding police and letting criminals out of jail?

My prediction: SCOTUS won’t hear the case.

That would be my bet. There is absolutely nothing here to indicate that a President enjoys "absolute immunity". The SCOTUS can just deny cert and that's it. There is no reason to delay this trial any more than it's already been delayed.

    That would be AWESOME...
BUT--I have a feeling they will get involved at some point...

Good point, but also the party of big government, higher taxes, vax/mask mandates, and gun control.

Because pretending to have total immunity as President has nothing to do with authoritarianism....

Both parties like big govt, just for different uses

No vax mandate, testing in lieu of was always an option

The aim wasn't to win, but to delay the case.

Prosecuting political opponents is straight out of the authoritarian playbook.

Thats a fair statement, Unfortunately, testing was not an option for many who had to choose between their jobs or being a lab rat.

Should it be illegal to charge someone in a different party? That’s nutty lol
Run for office, you’re not immune from prosecution?

I don’t believe you about not being able to test instead of getting the jab. I don’t know anyone who was refused to test instead.

    LoL

The record is more than scratched.

    Find something else.

Trump has been arrested 4 times, even his own attorney general says he's toasted.

His former chief of staff will testify against him along with 20 of his former aides.

Trump is more of a mob boss than a politician.

Big government: They both are big government. Nice repetition of a talking point.
Higher taxes: How stuff gets paid for. I guess you like running up debt then?
Vax/mask mandates: as opposed to abortion/medical mandates?
Gun control: Yeah, we shouldn't have any gun control. What could go wrong?

Off to the USSC for their ruling.

Still waiting for Biden to issue an assassination hit on trump, since he has immunity.

Can't believe his lawyers are that ignorant of laws.

An impeachment has nothing at all to do with laws. It is nothing more than a political maneuver.
That has to be the weakest argument ever presented.

What is the 'left'? MAGA, I guess. They were the group trying to stop the democratic election process.

Or is the post meant to say, I have nothing to offer so I will just use the words, 'the left'?
