Why? No damages. No victim. No crime.

Are you telling me someone can be charged for a crime even if nobody was hurt, and no one was damaged?

No. I am telling you that it is dangerous if you continue to be a passenger in a car driven by someone who drives drunk all the time.

I didn’t say I was a passenger. But I’m glad you agree it’s not illegal.

It is wise of you not to be a passenger.

If someone counterfeited only $100 and spent it, undetected because it was a perfect creation, is anyone harmed?

No, but it's still a crime against the state.

The proof is that if everyone did it, prices and costs would go up.

so, a small amount of theft to the system might not be felt, but it' still theft, fraud, etc.

If you dumped an open bottle of mercury into the ocean, it would dilute so great it would harm no one.

But, if every one did it, it would harm life, in general.

Clearly you do not understand the law and why it is a crime.

    Please educate yourself.

This is a case of the state creating a "crime" against an individual.

The laws in question have been on the books since 1965.

Continuing to make the “no damages” argument is meaningless. The fraud is explained in the Decision and rooted in the law.
The fact you continue to ignore it is your problem .

    And Trump’s.

The statute was passed by the NY legislature in 1956 as a consumer protection statute. Letitia and Arthur - show me the man and I'll manufacture a crime. And that is exactly what they did and that is exactly how banana republics work.

Show me the persistent offender and I’ll show you a DA willing to prosecute. Too bad the Orange Stain is a persistent offender.
What an arrogant moron thinking he could repeatedly violate the law without getting prosecuted.

Your post doesn’t make sense. Your claim of a “persistent offender” has not resulted in any DA willing to prosecute. You have just conceded that the prosecution by Letitia is a one off politically motivated banana republic action.

Fo you have any contemporaneous evidence of that? Or just after-the-fact commentary?

Either way, it’s irrelevant. Laws are interpreted as written.

Laws can and in this case have been used to manufacture crimes against individuals.

Dershowitz - Bond action of NY court is unconstitutional because it effectively denies the right to appeal the verdict. But of course the Constitution doesn't matter to Letitia and Arthur.

When he appeals and loses — are you going to accept the result?

Honestly, what would it take for you to accept it?

Because showing he openly lied to the bank to secure lower interest rates isn’t enough — what would it take?

This will go to the Supreme Court who will rule that this NY state decision is unconstitutional.

You didn’t answer the question — which is answer enough. You will never accept this ruling no matter how many courts this goes through because you don’t really care about the facts and case law — you just don’t like it.

On what grounds is this unconstitutional?

If you argue the fine is excessive that won’t hold water as that was the value of the loss. He was given a trial. It was speedy and not delayed. The evidence of fraud is there.

Furthermore, he hasn’t been even screaming to get it to them like he has in other cases.

But you might be right, the current USSC is the best that right wing federalist money can buy.
