What I expect is the argument on how this case applies to a child of someone in the country illegally, but the 14th Amendment didn't apply to Indians who were in the country legally and were not covered by common law exceptions. In fact, Jefferson dissolved the lower Federal courts so he could appoint new judges and Congress shuttered the SCOTUS for a term by withholding it's funding. Of course that was in the quaint old times before the judiciary was recast as an infallible super legislature.
