woman sent to prison for "sexual assault" for misrepresenting her gender

    Well if you're tricking a woman who is heterosexual into homosexual sex then yes that could be considered rape.

    But there is a special exception for gender bending for some reason.

    Take for example if a man was dressed up in a costume and a woman was with a man dressed up in the same costume and mistakes the man for the guy she was with and the guy has sex with her that would be right even though it was consensual.

    It wasn't informed consent. If you are not informed on the person that's sex or if the person is deliberately concealing their sex then you can't give informed consent.

    so if say a past President lied about his wealth, that would be rape?

    No, but she manipulated and played on the other woman's emotions, to get her to believe and do things that were implausible, in retrospect.

    Not everyone would agree with that.

    However, if the victim had been drinking lots of alcohol (as is usually the case), most people will say it's the fault of the victim.

    it's not rape, if they consent many times over 2 years.... that is on them, they could of said no at any time, if the person did not stop, then it's rape

    I thought your argument more logically shows that they should not be convicted of repeated rapes than it does logically show that they should not be convicted of rape at all.

    Do you understand what I am saying?

    (Your argument can be used to argue that it was not rape, but your argument is stronger if it is only arguing they should be seen as guilty of only one rape)

    She might have "come back for more", but the circumstances of the second and third times were the same as the first. She willingly entered into sex on the first time.
    So your argument is not so much applicable here, as it would be with a normal rape where we are questioning whether the woman willingly entered into it.

    that would really depend on who was taken advantage of and he was taking advantage.
    Taking advantage of someone who is in an incapacitated position such as being drunk is considered rape.

    It's the same thing in this case there is no informed consent. The informed consent would require information about the sex of the person.

    it's deceiving, she may have not consented if she knew, that is what they are saying is rape

    same with people that lie about being married

    But it's a different type of thing. It has to do with something that is external, not his body or the sex act.

    According to your view, the woman is practically a prostitute, and she has been denied compensation for her services.
    (Unless you argue genetic correlation and possibility of pregnancy)

    yeah it is, you can tell if someone is lying about their gender easily before having sex, not so much on wealth

    Usually, but not in some circumstances.

    This was one of those circumstances. The woman was unable to see or use her hands to feel during the sex.

    I get the feeling you didn't read the story.

    Pretending to be a different gender is a pretty big thing. It's not just like a comb-over.

    That's my point. And if they lie about who the person is to get consent that cannot be informed consent because they don't have the information.

    If they lie about money that isn't a lie about who they are.

    If informed consent is the bench mark, than ALL lies count.

    If she refuses to date a non vegan, and a meat lover lies, she didn’t consent.

    I think this is just a very embarrassed woman.

    Perhaps she spends way too much time telling her friends she’s not a lesbian.she spends two years having lesbian sex, so she clearly loved it.

    that’s as conceivable as she never cuddled with “him…”

    The perpetrator used an elaborate excuse and emotional manipulation to make sure her hands were tied up and she had a blindfold on at all times.

    It is conceivable that she did not actually know.
    Even though she should have been suspicious (but some women do not see red flags when they imagine themselves to be in love).

    That is what this case revolves around, in my opinion.

    If you could prove that this victim had slept with other women in the past, then the entire charges against the perpetrator would be dismissed.

    Lies about who the person is, not what they do for a living or their bank account. You don't have sex with what they do for a living or their bank account.
    False. You don't have sex with a person's diet.

    I don't think that's okay. If the person she has sex with lied about who they were it doesn't matter. Deception about who you are to gain consent doesn't change.
