Yale Legal Scholar and Oathkeeper: NDAA is "Declaration of War" on American People

    In a speech before country sheriffs, active duty military and law enforcement personnel, founder of the Oath Keepers and legal scholar Stewart Rhodes says NDAA indefinite military detention of US citizens is a "declaration of war" on the American people. Rhodes says that by destroying the very Constitution which grants them the authority to govern, the congressmen who are attempting to enact illegal legislation have lost their legitimacy.

    Rhodes points out that the Constitution already makes provisions for treason in wartime in Article 3, the "treason clause." The Treason Clause requires a civil trial and the testimony of two witnesses, or confession, for conviction:

    Rhodes explains that the present expansion of military jurisdiction to domestic soil has been attempted before in American history, but that until World War II, it was struck down. Rhodes has argued that US Supreme Court decisions which interpret presently claimed NDAA and assassination powers as extensions of the Authorization for the Use of Military Force are flawed. Rhodes says that, contrary to present day claims that the Constitution is outdated, the Founders lived in times of peril and and terror and constructed the Constitution to adequately deal with all contingencies.

    Rhodes is a graduate of, and has taught at, Yale Law School. He is the founder of Oath Keepers, an organization of military and law enforcement professionals, both active duty and former, who have vowed to stand down and disobey orders which violate their primary oath to uphold the US Constitution.

    So the president is a king? Because those are king's powers. Someone should update you about a thing called the American Revolution. You obviously never heard of it.

    The problem with this thread is that it is a) intellectual, b) true, and c) not sexy.

    You need to talk about Christianity, gays, or use the word "negro" to get people to post on a thread it seems.

    I think people look at these threads but don't quite know what to comment. I call it wise to keep my mouth shut when I don't know what I'm talking about, unlike the guy who just said the president can do what he wants. The problem with democracy is everyone gets to vote.

    okay, how about a reality show pitting a christian, a gay, and a black person in a singing contest every week?

    Well...I know what to comment because I've been saying the exact same thing as this professor to a big old chorus of crickets. It's frustrating that people either don't care or trust that the government won't abuse these powers. They don't seem to get that allowing this to stand sets the stage for greater usurpation of rights.

    My own personal feeling is that people feel powerless to do anything about these things. They'll listen to you preach and then after get mad and yell "what do you what do you want me to do about it?" They have decided that writing to congressmen is pretty futile and we are too small. But mass awakenings happen. A week before the Tunesian revolution everything was normal and people were talking about the soccer game. But when it happens, and people have had enough, it happens fast. It might take an economic crash but we'll get there.

    The US Government is not an enemy of the People. It is too big, to incompetent and too corrupt. But it is not a malevolent, diabolical organism out to eat you and your social freedom.

    The only thing under assault in this country is fiscal and economic freedom of the entreprenurial class. That is the biggest threat to freedom our Government imposes.

    Not imprisonment or death or toture.

    Since the order by President Obama for the extrajudicial assassination of an American citizen, it seems to have brought into focus some potential issues related to the NDAA.

    "It" is a collection of humans most of whom would throw an old lady in front of a bus to get re-elected. Look at the laws they write, how they've shat upon the Constitution and then show me again how those cats are "friends" of the people instead of our enemy.

    The United States Government should focus on creating a country that people do not WANT to attack, versus creating a system which people will celebrate about its collapse!!
