    It is the classifier's call as to whether something is classified. The Classifier in this case was the Secretary of State. As noted in your source "The decision to mark a document is more art than science and leads to bureaucratic in-fighting on whether something should be classified or not," said Gary Bass, Bauman Foundation executive director and former director of OMB Watch, a government accountability organization." The classification of an item three years after its creation is not and indicator that it should have been classified earlier. THAT is the decision of the Classifier.

    Hopefully, the Democrats have cheesed off Sessions enough to follow through with the above, it's a target rich environment.

    "STANDARD MARKING ELEMENTS apply to all documents, including those processed in an electronic environment such as email, and are as follows:
    • BANNER LINE (Examples provided in Figure 1): o Specify the highest level of classification (Confidential, Secret, Top Secret) contained in any portion of the document. o Classification level must be spelled out...."

    Just placing a (C) at the beginning of a sentence does not mean the section is classified ESPECIALLY if the document is not properly marked. and more ESPECIALLY if the system is not classified.

    It can also mean Copyright (C)

    No proper classified markings and not on a classified system. Without the proper markings there's no reason to suspect a document is classified especially when it is on an unclassified system.

    I'm not saying she could not have recognized that a leakage had occurred but given the fact that classification was not her expertise, she'd had no training on classification, and the fact that this was an unclassified system, she had no reason to suspect that the emails she was receiving contained classified information.

    She like everyone who receives clearance are SCHOOLED in what is classified information and are SCHOOLED that is may not be marked with anything but it is STILL CLASSIFIED INFORMATION and their responsibility to treat it accordingly. Comey testified it was clearly classified information and her responsibility to treat it accordingly.

    the (c) was at the beginning of the paragraph. The fact that someone was apparently copying, either by hand or some other way, emails or documents from classified systems into an unclassified one doesn't declassify. If you strip the headers from a classified document, it's still classified. I can't believe for one moment that someone who is experienced working with classified material would see that and not realize that was meant as a classification, even with headers stripped off.

    Without the banner and the proper classification on an unclassified system the symbol (c) is more likely to refer to a copyright than it is to a classification.

    Just to be clear, you are arguing that if you scan a classified document with all of the classified headings, remove the headings, then the document is no longer classified? You're quoting the requirements for sending classified email. Hillary is a case study on sending it incorrectly, and on an unauthorized system.

    I find it really amazing that you guys will go to any lengths to defend grandma felony. It's just stunning to me.

    If you scan a classified document on an unclassified scanner you've committed a violation.
    If you then remove the headings you've committed a violation.
    If you know to do that and don't then also remove the paragraph markings you're ...

    If someone goes to that effort and then emails the document on an unclassified system how is the receiver of the email to know that (C) is a marking for "Classified" and not the expected, given the environment, symbol for "Copyright?"

    And if you're going to keep beating that dead dog I will most certainly be happy to make you look the fool for doing it.

    What you are claiming is that an improperly marked document on an unclassified system should be recognized as classified even though it contains no classified markings.
