They would have absolutely abhorred impeachment for political gain, and so stated often. They just couldn't find a simple way to fence it in. What silly history books do you read?
Your scenario requires a belief the founders anticipated today's hyper-partisanship and the ability of a fundamentally corrupt Senate majority leader to literally keep a seat on the SC open for years..........and had no problem with it. That's just manifestly ridiculous, as you know.
They would not have advocated a prez getting away traitorous behavior that is self-serving, unethical, and illegal.
No, it is not ridiculous in the least. You evidently think the framers were morons with no understanding of people or politics. When was any SC seat kept "open for years" by any political faction? ANS: never, so quit spouting such nonsense.
Why is everybody talking to me about cloture? I said nothing about cloture. What the constitution says is that a President governs for four years. And a session of Congress is 1 year long. Moscow Mitch changed that for SCOTUS nominations when they were made during an election year. That started the constitutional crisis. Then he changed it again for SCOTUS nominations if the election was a mid-term. Now he wants to change it a third time to... whatever is convenient to one political party. That is not how a Republic works.
You wrote......"Where in the Constitution does it say that the senate must vote on a nominee within a certain time period? Do you ever read and understand the Constitution?" Your "logic" has officially become circular and thus contradictory.
my guess is the liars of the GOP will win this battle but they will lose the war kinda sad as a lifelong republican, I could not accept the ruthlessness of the GOP I drew a line in the sand and GOP crossed it how can any woman or man with an ounce of integrity vote for trump?? I understand the radical white nationalists supporting trump it is time for guys like moscow mitch and lightfooted lindsey to go they consider themselves gods depsite having NO integrity, they have NO respect for their supporters trump supporters are chumps winning a battle will not win a war
Let's try the present method and fill the immediate vacancy as DICTATED, then after Trump's victory let the angry Democrats try some new stunt --- or maybe old ones like burning our cities --- trying to show they're so adult we must vote them in as leaders.
The only thing we know for certain is they did not impose a statutory maximum number. The door is open. Under Biden (well, under the communists socialists and Harris), those "average citizens" will be like that Wall of Mothers which started out as a militant group but changed its name to get the publicity. "Average" union officials, "average" teachers with all the proper screaming-meemy credentials. Here and there a malcontent military member and many hugely-disgruntled FORMER military (with suspect discharges but who's counting?). Hair on fire liberals, all. It's an election year. The Dems try cleaning up their act but they never ever quite manage to get that right.
Whatever McConnell did as senate majority leader was based on cloture, and was completely constitutional, ergo causing no constitutional crises. I have no clue what the term of the president or length of a congressional session has to do with anything.
I have no idea what you are getting at. You are the one that implied the senate has a constitutional obligation to vote on a court nominee within some certain time. I simply ask where it says that.
I'm thrilled to see that right wingers see liberals as such kind individuals that they demand nothing less than "saint-like" behavior from us. Yes. Liberals are the good guys. But we're not that good. Just like you are the bad guys. But not that... well... let's leave it at that.
All I know is that RGB herself, said the Senate should have confirmation hearings....to me that's it....https://www.foxnews.com/politics/flashback-in-2016-ginsburg-senate-election-year-vacancy I mean, I get the Biden Rule has been around since 92, and reaffirmed in 07 by Chuck S....but after RGB said what she said about the Senate's duty...and the fallout from the Dems when their rule was enforced...I think McConnell did the right thing killing it....and we need to follow what RGB said....that's about as close as we are gonna get on the Court's view of the Dems BIden Rule
If democrats really think that is ok, then perhaps Trump should do it. How would that grab you democrats?
You don't think the Founders anticpated hyper partisanship? For goodness sake....our First Sec of Tres was shot and killed by our third VP....
No it wasn't. Merrick Garland was never even given a hearing. Much less a vote for cloture. The Constitution states that the Senate gives (or rejects) consent of the President's nominee. Nowhere does it say, or imply, that Mitch McConnell does. McConnell hijacked the Constitution. And he keeps changing the rules according to the partisan interests of ONE Political Party. That is an ongoing constitutional crisis. All of it caused and maintained by Moscow Mitch.
Somewhere along the way, you've missed what "court-packing" means. It's a reference to expanding the size of the Supreme Court, to allow the President to alter the balance of the court by filling many of these newly-created seats at once. It does not refer to routine filling of seats as vacancies arise from death or retirements.
For many years, I have openly supported the idea that we bring dueling back to Congress. It encourages less time in cocktail sessions and more time on the gun range. Gridlock will still be mandatory but civil.
This is my thought. The judiciary has the power to overturn laws. I don't know why they dems think the judiciary would take their attack lying down.
Bad people like me want honest elections and all Americans get a chance to live and prosper. Bad people like me want government to loosen its regulatory grip over the very same professions like barbering or hairdressing which are occupations being taught in our prisons. Are a zillion hours of training truly necessary to shampoo some matron's hair? The list of overly-regulated occupations is so long that it fully deserves its own thread, but the general idea remains. Get government out of America's hair. Oh yeah. Bad people like me. I find and quote stuff. Nasty old me. The English philosopher Lord Shaftesbury (d.1713) remarked, "It is the hardest thing in the world to be a good thinker without being a good self-examiner." Evil me. I took that to heart. Can the libs?
