In your mind "established" equates to .... what again? The Constitution requires the President to nominate. Precedent amply exists to show he's not inventing law. The Constitution was emended on length of time allowed for the Senate to take action. No matter what Trump does the Senate can ice the thing until after he's gone or until he starts breathing down their necks following what I contend will be his reelection. Even one Democrat voting for the nominee and with Pence riding shotgun that buckboard will thunder to victory and no horse need lose a shoe. That assumes Murkowski and Collins remain the treacherous hags they have always been. Should either repent, the Dem who sees the light won't be needed in a straight-up partisan vote. Trump will trot to triumph. Huzzah! America made great again.

Then in the absence of contrary established law, the chief executive has that say, through executive orders. It's Trump's watch and Trump's legal requirement meaning Trump's nonpartisan DUTY to obey. Get the nomination out there. It won't be the only thing we'll argue about long into 2025 when Trump finally leaves, America stronger for the experience. Obama didn't end the Afghan war, folks. He botched mideast peace and sided with the muslims over Israel. Bowed to foreign tyrants. Really not very classy at all. Trump? He'll be like Reagan, appreciated decades later for what he did. Now we just help keep him doing it. And wait for Biden at the debates.
It's certainly screwed up the Dem Party's "2020 is ALL about Covid-19 and racism!" propaganda in which their politically loyal media outlets direct and control the narrative.
That would have collapsed anyway at the first debate. Biden's debilitation would control the media because too many people would see for themselves what clever editing or selective use of footage cannot conceal. Did it HELP break the focus? Abso-bloody-lutely. That and so few Biden sightings or campaign crowds. The enthusiam isn't there and COVID separation cannot be blamed. No real crowds are turning out. For Trump they are.
I don't see anything at all unconstitutional. A bad idea, yeah. But nothing that violates the current Constitution.
It has to clear both houses and be signed by the POTUS like any other law (or passed and the veto overriden). It won't happen though. The democrats threatening things just reminds people why they don't like them. They are playing to their base at the expense of swing voters with this pack the court, impeach the president crap.
If Trump does this and loses the election and the Senate goes Dem? You bet there will be a court expansion They'd be hard pressed to not make DC AND PR states as well
And run the risk of Republican retaliation when they retake the Senate and presidency? Aren't you taking one hell of a risk?
PR generally votes against becoming a state. They like the 1 foot in and 1 foot out status. The Senate may end up in a 50/50 putting the VP as the deciding vote assuming they change the rules make to majority rules instead of the 60 vote rule
And Dems are already crafting legislation putting power back in the hands of Congress and curbing the Executive.
