    Race has no rational relation to the governmental interest in more children with both their mother and father and fewer with only one or neither their mother or father. Interracial couples procreate just like same race couples. The children of interracial couples benefit from a stable home just like children of same race couples. ON THE OTHER HAND, the limitation to heterosexual couples IS rationally to that interest. Only heterosexual couples produce children.

    Virginia's new attorney general Mark Herring is making a major reversal on his state's same-sex marriage stance, according to The Washington Post and NPR.

    Herring will announce on Thursday that he finds Virginia's same-sex marriage ban to be unconstitutional, The Washington Post reported.

    "As attorney general, I cannot and will not defend laws that violate Virginians' rights," Herring told "Morning Edition." :oldman:

    The action will mark a stunning reversal in the state’s legal position on same-sex marriage and is a result of November elections in which Democrats swept the state’s top offices. Herring’s predecessor, Republican Ken Cuccinelli II, adamantly opposes gay marriage and had vowed to defend Virginia’s constitutional amendment banning such unions, which was passed in 2006 with the support of 57 percent of voters.

    Judges are only "activists" when they:

    1. Uphold the law.
    2. The law promotes equality.
