Federal judge poised to set Trump trial date in election interference case

    U.S. District Judge Tanya Chutkan will hear arguments from Trump's lawyers and federal prosecutors on whether the historic trial should begin before or after next year's presidential election.

    Special counsel Jack Smith has proposed that the trial start in January, with jury selection beginning in December, while Trump’s team says the trial should be pushed back until April 2026.

    Since we don't have a perma-thread (forum?) for the various Trump prosecutions, I'm forced to make a new thread for each sub-event along the way. Yay! Hopefully, we can use this one going forward for the DC Jack case.... I will, should events warrant it...

    Hearing should be starting by the time I press Create Thread.

    My personal prediction is Judge T will choose neither requested date, but will certainly keep it in 2024, since the Trump team argument is ridiculous on its face..

    I'm going February 10th. 2024. I didn't like Jack's plan to pick the jury in December, then go dormant over the XMAS/New Year break. Lets keep it going with few large breaks.

    I hope they convict trump and lock him up for life. He shouldn't have the right to run for office!

    Looks like Alvin Bragg is going to have to move.... I wonder if that judge will be able to move that one earlier? Since it's such a nothing case, and all (sarcasm)

    Fani had requested March for some of her case as well, so she's probably going to have to adjust some too

    He has the right to run for office even if he's in prison. The Trump supporters who claim that he should be exempt from the law just because he is running are absolutely unhinged.

    That would be a poor use of federal (or state) resouces. Presumably somebody else will be using that cell after him...

    The only way I see him going to prison (and trust me, I WANT him behind bars) is if they clear out an entire cell block for him alone. Replace all of the guards with Secret Service. That is the only way the SS will be on board with putting him in a prison.

    The only other possibility is that before he is convicted Congress passes legislation to the effect that if an Ex POTUS is found guilty of a felony then their life long protection by the SS is rescinded.

    They would have to do it before he is convicted or else he would be protected by the Constitutional prohibition on "Ex Post Facto" laws.

    Former secret service people have already said they'd just have a guy or two assigned to him at all times. He wouldn't be the first inmate to need to be segregated from the general population, either.

    But in this case it's not just segregated from the general population. I believe that the SS would demand he be segregated from any guards as well.

    All there would have to be is one guard who is anti Trump and that guard does something. I don't see the SS allowing anyone to guard Trump other than themselves.

    I don't think he would need to be segregated from guards in general, but I wouldn't be surprised if the SS were picky about which guards were around (i.e. if they have any history of violent anti-Trump rhetoric, then they wouldn't be allowed around). Personally I'd recommend segregated with two armed secret service at all times. If two were there and armed, no single crazy person would succeed in assassinating him. Less reliable with a single armed guard.

    Most anti-Trump people would frankly enjoy him rotting in prison too much to feel a need to kill him. But I guess who knows how a crazy person would think.

    I brought that concept up last week... I think it's a helluva idea...

    My personal favorite for an incarceration plan is a "halfway house", where just Trump and whatever SS he has are the sole occupants.

    Note that the DOJ/State select the property, and it ain't gonna be resort quality. Secure, private, but bare bones...

    Obviously, that would involve 24x7 ankle monitoring, not that there wouldn't be media outside at all times to ensure he doesn't sneak out for some unknown purpose.

    My other requirement I would insist on is that he have a complete ban from using social media. If he is allowed access to a computer it would be monitored 24/7

    Depends on if current inmates (Fed/State) have access to social media... He can't have less access than anybody else. But good thought...

    Not having access to social media would be the best punishment, and add house arrest, would be great.

    At this point I don't think Trump cares what argument is used, just as long as it can push the trial until after the election.

    To be fair though, she did warn him that if he couldn't keep his client quiet then she would be inclined to an earlier rather than a later date.

    This case should begin in early-to-mid 2025. The early 2024 date, gives more or less 5-7 months. Given the legal complexities of the case, I am inclined to agree with the defense. This is not enough time to formulate a defense for a client with these charges.

    March 4, 2024... For the hard of dating, that's exactly 7 months and 3 days since indictment (8/1), when the clock started.. If you can't cook up a defense in that time, perhaps Lauro is not your guy...

    I recommend he spend more time planning and less time on TV.

    The good news for the defense is you have to spend exactly zero seconds on prepping Trump for any trial.

    I can't imagine him ever taking the stand. for that matter ever wanting to go to trial.
    Which means I see him begging for a plea deal.
    What could Fani/prosecutors even negotiate if she was willing?

    For starters the blithering idiot would have to keep his mouth shut during the trial which is unimaginable.
