Only if they can A) afford a lawyer (which if they're looking for work, the answer is likely no) B) can prove that the reason they weren't hired was for a discriminatory reason, which isn't very easy.
All the plaintiff has to do is show a disparate impact upon the minority in question, and the burden shifts to the defendant to prove the absence of discrimination.
I believe all states have administrative procedures for filing a complaint that doesnt require an attorney, when it comes to discrimination claims in employment.And will usually provide them if needed to those who cannot afford one. Usually pressuring both sides to settle the case to avoid the expense of the courts.
Because lawyers don't take cases on basis of 1/3 if they win. All those ambulance chasers require up front retainers...
The complaint has to have merit, it won't be any different than any other type of discrimination. Operate on the up and up and generally there's nothing to worry about. I'll admit however that yes, some discrimination cases are fought and won or settled that have have no merit.

You most certainly cannot, if that was the case there would be no more racism, sexism, or religious intolerance. You can try to curb the negative effects of it through laws but people will still hate and thats not tolerance.

Boehner is likely just representing his constituents, which is fine. If most people in his district are against it he should vote against it. However, since polls show a majority of Americans support DOMA, if he blocks a vote on this or the House ultimately votes against it, it's clear that the people in the House of Representatives aren't doing their job of representing the people.

People get fired and bullied for being perceived as gay all the time - whether they are or aren't in fact homosexual in their orientation. That it has to be confirmed by the person to ascertain, is no more relevant to this debate than a person who is discriminated against for their religion. You could argue the same - if Christians didn't make such a big song and dance about their personal beliefs perhaps they would not face so much "discrimination"...
