Property owners, shooting trespassers is a criminal act.

    The fact that it is not trespassing criminally unless it is posted or fenced or someone tells you to leave.

    Otherwise ever entering private property without permission would be automatic trust pass

    Getting shot for trespassing is far from the worst thing that could happen to you. You climb a fence into the wrong persons property and either get tore apart by dogs, or they might just keep you in their basement for 10 years to let you think about it. Long story short, dont trespass onto property that you don't have permission to be on, sign or no sign. You shouldn't need to have a sign on your front door that says do not enter. If its not your damn house, stay out.

    Oh, I totally agree, which is why I like the land trust system. The state maintains the trail systems that people are able to access, and pretty much handles going after those who abuse the land trust system. I think it is a win win for everybody. People are not able to wander everywhere on the property, just the designated trail systems, which are just beautiful. It would be a shame for all that not to be experienced by everyone who wants it.

    I've got an 8-foot high wall all the way around my property. If you are on my property, you either scaled the wall or broke through a gate. In either case, you have no legitimate reason to be on my property, and your dumb ass is getting shot...

    The last thing I would ever want to do is kill another human being. Since I live in the city, if someone is in my back yard, they jumped a wall and can't say they are lost. I should at least get to blast them with rock salt.

    My vehicle is also my private property. Are we required to have multiple signs on our vehicles saying "No Trespassing"? No, we aren't. And entering someone else's vehicle without permission or breaking into it is 110% ILLEGAL.

    Me thinks there are a lot of internet warriors in this thread talking up a bigger game than they are capable of. I've often found those who talk a big game usually have no game at all.

    Everyone who thinks that trespassing is okay, let me know and I'll set up camp in your backyard when I come through. Maybe watch a little TV through your living room window while I'm there. I already know I'm not going to get shot...

    If you're not an imediate threat to my personal safety or the safety of my family, in my State, they prefer I call the police or sheriff and let them handle it. As do I. I have no possessions worth somebody's life. IF you (in this scenario) were to threaten my life or my family's ... or anybody's, then that would be a different story.

    Carrying a gun while confronting a trespasser isn't categorized as a criminal action either. Brandishing the weapon probably would be, but its been repeatedly established in court that merely carrying a weapon =\= 'brandishing' a weapon.

    So far as I've seen, people shooting trespassers who arent engaged in other violent crime while trespassing is pretty low... what specifically is the issue you're attempting to address here?

    I started this this thread to draw attention to
    the appropriate level of response to the appropriate situation.

    I'm not a lawyer. But I did study the differences between criminal and civil cases for a school class a few semesters ago. Not an expert, just bringing up an item of note.

    Law's governing firearms and their use vary dramatically from State to State. IMHO, every gun owner should take a concealed carry class or firearms safety class so they know the law.

    But! No matter what the law is, could you live with yourself if you killed someone because they walked into your back yard, sat down and put their feet up on the picnic table? :eyepopping:

    You’ve surrounded your entire farm with fencing? How big is this farm? I only ask because I have never seen an entire farm fenced in.
