    If they trespass into a house it is legal. You don’t know what their intent is so it is legal to defend yourself with deadly intent inside your home.

    Your biggest single error is making it one size fits all. There are different circumstances. I do not have a problem with trespassers coming on my land. It is the same for most land owners in this area. I have no hunting signs, but would not shoot someone over it.

    However, I do expect you to respect my property. A lady tampered with one of my game cameras and stole a camera. We had some ginseng which was pulled up and is not likely to grow back. I suspect it was a woman because I got a picture of her carrying a rifle and the tools to harvest ginseng. I turned the picture over to the law enforcement. She was never identified.

    it really depends, a child taking a shortcut across an old man's lawn should not be used as target practice

    but if an area has a wall and someone has to work at it to get in, then that could be a valid threat

    really depends on the situation

    Here in the State of Florida that's considered felony trespass if you trespass while armed.

    It turns out the majority of trespassers probably don't have good intentions. Or they would respect what is most of the time obviously private property.

    Now what if she would have pitched a tent or built a small shelter and proceeded to live there and called it her own and then proceeded to put two or three pickup truck loads worth of trash on your property.

    That's the reality of some trespassers they come to squat. How would you feel about it then?

    Tell me how I'm making it one size fits all?

    Instead of wondering if your trespasser will be a good one or not why not just control your private property and if someone comes to you and ask you if they can be on your land at that point in time then you can determine if you want them on your land?

    This entire op is predicated upon a straw man. At no point in time is it legal to shoot at or shoot a simple trespasser. Anyone who does so would find their self on the way to prison. Assuming that they were caught doing this of course..... Because after all nothing is illegal unless you get caught. And no one should take my previous sentence as an encouragement to ever shoot anyone in an illegal manner. I do not advocate for breaking the law. I also do not advocate for acts of illegal violence

    Now if you were to go and confront a trespasser and advise them that you wish them to leave your property and then they presented a genuine physical threat to you then the situation would change. But you can't just go shooting people because I'm told that's considered rather rude and impolite

    And I reported her to law enforcement, as I stated previously. The rest is just "what ifs".

    Depending on the state, there is a criminal trespass and civil trespass. The main difference is that it has to do with intent, among other things. Criminal Trespass in Texas can be found un the Texas Penal Code section § 30.05 and civil trespass can be found in Texas Civil Practices and Remedies Section § 75.01 et al.

    However, for use of deadly force to be justified, no matter the circumstances, one must be in reasonable fear of imminent bodily harm or death. Some states employ the Castle Doctrine of when that applies, one or two states use the "Stand Your Ground" Doctrine, and all states use the traditional doctrine of pure "self-defense" of your person doctrine.

    No the hell it's not, it's often a reality.
    If you want to pay a lot of good money and let someone come on your private land and do whatever the hell they want then I guess that's your choice. Good luck with it and I hope it works out for you.

    That's called the Castle Doctrine which Texas and other states have. However, if one breaks into your vehicle, that is not considered trespass, criminal or otherwise, it could be considered grand larceny assuming the value of your vehicle is above $1500.

    However, even under the Castle Doctrine, you need to show/prove/reasonablely believe, your life was in danger or in imminent threat of bodily harm. That would depend on facts and circumstances in your specific situation.

    Let me guess, a Brahma Bull right? Nasty little buggers.

    However, depending on the state, I will warn you that type of approach will get you into more legal trouble than you realize, especially if a police officer is doing their job. They may or may not use that intercom.

    There is nothing "paranoid" about wanting people without your permission to stay off of your property that you worked hard your whole life to purchase and own.

    Just like there is nothing "xenophobic" about wanting people to immigrate in the legal manner.
