She's detained, her movements are controlled by the officer, and he gave her a lawful order, which she refused.

- - - Updated - - -

It becomes a safety issue when she flicks it into his face.

Most of the time, its departmental policy.

But the fact you criticize his request rather than her refusal speaks volumes.

bull crap ten years ago I witnessed a hit and run outside a bar the cops was called and one approached me to get my statement on what happened. I was smoking and the officer asked me to put out my cigarette. I said "sorry I didn't know smoking bothered you" and he said "no it isn't that I smoke also but a lit cigarette can be used as a weapon" I said "I understand" and put it out

Please use some commonsense. And if you are stopped by a cop....I'd suggest you put your hands on the steering will, even though there is no law demanding you do so, and refrain from digging for something under your seat, even though digging under your seat is perfectly legal. Cops have the authority to keep safe.

In practice, cops have the authority to do anything they want. It's nearly impossible to indict them. They can taze you, shoot you, beat you, call it necessary and it becomes necessary. I do hope that the increasing prevalence of cameras in phones slows them down a bit.

Why do you keep making sh** up? Where does it say she flicked it in his face? And you haven't showed me the law that says she can't smoke in her own car.

She didn't. But she could have. Is that confusing?

She was being detained for a violation of the law. Therefore she's required to comply with lawful orders. He told her to put it out, which is a lawful order, and she didn't. Is THAT confusing?

- - - Updated - - -

And he's being charged like you or I would if we shot someone in the same circumstances.

So not really sure what your point is?

Oh, so you are making stuff up. Thanks for letting us know.

My point starts in the first sentence. Is it that hard to comprehend?

All of this, because someone changed lanes to get out of HIS way. Headlines: trooper resigns, county settles civil lawsuit, wash, rinse, repeat.

Funny how conservatives are so concerned for the taxpayer, but then condone stupidity like this.

I didn't make up anything.

And yeah, cops are human, they make mistakes. In that case, he did a (*)(*)(*)(*) poor job and not only shouldn't be a police officer, but should be in jail, which is likely where he's going. Other than being charged, what else are you looking for?

Or maybe the cop can not be an (*)(*)(*)(*)(*)(*)(*), back away while he writes the ticket, and let the woman smoke her cigarette.

That cop was a bully. He pulled his gun on an unarmed woman and forced her out of her car for asking why she should stop smoking, and for upholding her rights. The cop has already assaulted her. Not much doubt that he took her off camera so he could assault her more.
And this is proven by her protesting that he's about to break her wrists. He continues to assault her. He slammed her head into the ground, another assault.
If they condone the actions of that cop, perhaps they went a step further and killed her and are pretending it's suicide. After all, she Black.

When a cop is putting you to his law, he is violating every right you have, even the right to life. And making a big deal about her smoking in her car, was putting her to his law. This is a chief violation of the Common Law of America we inherited from Britain.

As if there is not enough evidence of their mal intent, they may have edited the video of the assault to protect themselves.

The policeman had no right to insist that she put her cigarette out. Actually he did not order her to, he simply asked her to. Then he had absolutely no right to order her to get out of her car or put his hands on her. The officer was totally out of control and should be fired and charged with assault. The dash cam video clearly shows that the police officer was totally out of line.
