Sotomayor compares fetus to brain dead person, says fetal movement doesn't prove consciousness

    US Supreme Court Judge Sonia Sotomayor compared a human fetus to a brain dead person, saying fetal movement doesn't prove consciousness.

    "Virtually every state defines a brain death as death. Yet, the literature is filled with episodes of people who are completely and utterly brain dead responding to stimuli," Sotomayor said. "There's about 40 percent of dead people who, if you touch their feet, the foot will recoil. There are spontaneous acts by dead brain people. So I don't think that a response by a fetus necessarily proves that there's a sensation of pain or that there's consciousness."

    Sotomayor also said that she believes the idea that a fetus is a human life is a "religious view."

    Sotomayor was appointed by former President Obama.

    She's uninformed regarding the constitution and her role in upholding it. She seems to think that the ruling of when life is valuable should come from her opinion .

    And as to biology. And she knows the Constitution, at least I hope she does, but has no concern for it. Those are decisions we the people should be making not those judges sitting up there.

    She is correct you know. Brain tissue does not develop the instant the egg is fertilised

    That doesn't matter it's not about his gainsaying hers, in her position as a Justice on the SCOTUS that is not her role to make that determination. It is for the people to make. I know you don't grasp that concept as you are not an American and do not understand my country and it's system of government.

    Biology doesnt denotes when life is valuable. Biology only settles that an unborn child is an individual human life. It doesn't decide when to kill it.

    It won't. But viewing life as valuable is dependent on culture and values which differ across the states. Our constitution is set up to allocate this decision to the legislature of each state.

    I guess all my analogies of patients in comas to the issue of abortion was not "just wacky" after all.

    This judge is clearly making a connection between the brain status of hospital patients and the rights (or lack thereof) of the unborn.

    No, it doesn't...in every poll since RvW most AMERICANS prefer abortion be legal


    The UNITED States gives ALL citizens the right to bodily autonomy....the states have NO right to take that away..

    They already do take away a woman's bodily autonomy when an unborn child is at certain gestation. What is not constitutional is when a few people in robes decide when it is OK to kill an unborn child and when it's not based on their own values and opinion and devoid of any constitutional legitimacy. Roe vs Wade is such an unconstitutional decision that the left is terrified of its own weakness.

    So you don't know it's called "viability", the ability to live outside the womb....which is why it was a sop to Anti-Choicers since NO mentally healthy woman requests an abortion after viability....a nothing burger..




    So you don't believe the Constitution includes women....shrug...

    “Alive” is what is moot here. For something to be considered alive there has to be a minimal level of brain function and not just automatic reactions

    Insufficient definition. As we all do not immediately start off with brain function and yet we are all growing and developing towards becoming a human adult. Sotomayor is an idiot.
