    Does public opinion matter in these things? I always thought as long as it was lawful it was good to go, and public notice of development was more about letting people come forward with actual legal reasons against it rather then the whole NIMBY phenomena. I hate rent a crowds no matter which side they are on. Stinky hippies

    It certainly should. Don't we live in democracy? If the majority of the community does not want a mosque then building approval should denied. Did the council even bother to gage public opinion beforehand?

    Just because we don't have a constitution doesn't mean our legal system does not protect the freedom of people to do anything lawful on their own property, so I guess it comes down to Council building and amenity restrictions. If they changed them for a particular property to suit public opinion, I'd imagine the owner could sue the Council for unfair treatment or discrimination. I'd have thought there would need to be some solid reason else all that public opinion is just a waste of breath. If all the posters here decided to kick off DaS for example, would it be democratic or just a majority bullying. Its a nice word democracy, but I think it has to be viewed in the broader legislative landscape.

    It is freedom of religion, and it goes both ways.
    Or we need to change the law to keep the Muslims out or/and deny them their faith.
    Abbott did the first step to stop the boats, but obviously modern Australians didn't like him, I wonder why!

    Some things shouldn't have required public opinion such as the woman's vote, indigenous citizenship, hell, even building a church down the street. Some things cease to amaze me with some of you. Everybody is happy to have a dan murphies or Tavern built in their local street, places that cause the greatest blights on our communities through domestic violence, drink driving and king hits that cause more deaths than you can poke a stick at!

    Of course....too much freedom....just like USA...hows that working for you....
    In Australia if a community doesnt want a mosque and the local government
    council reject the building application, the muslims can just take an appeal to the
    Anti Discrimination Board and it will be upheld....thats why there are so many mosques
    in Australia....the local communities no longer have any rights...they have been taken
    away by the AD Act....

    The community doesnt want the mosque because it represents Islam....

    Yeah...like the marriage license clerk in America that refused to do her job and issue a gay
    couple their marriage license because it was against her religion....pft....an SC Mandamus in Australia
    would have had her in gaol....
