Why is rape a crime?

    Different values for different people. I actually would not have to work a day in my life, but Im headed for California to start law school in the fall.
    Three years of very hard work, followed by even longer hours.

    As as general thing I agree but-"if life is not threatened" is not easily sorted out from that kind of violent abuse.

    its a lot more complex than that, but good to see you dont really hold the extreme position you seemed to in your first. i hope you'd try to post something closer to your real feeling next time, you kind of got my blood pressure up!     I guess in times past, there'd have been no help for you, and no sympathy, no understanding, a shameful secret, a character weakness.

    Women had to stay quiet and suffer in silence, too. Well, I for one,wont.
    But in past times, I'd have had to. Now I dont, and I will be d....d if I will let them get away with it on the level that its just hushed up.

    Like I said in the post directed to you that you ignored, that is how it should be and generally is. Discretionary sentencing depending on the individual case.

    Suitable, proportionate sentencing, and adequate victim care, those are worthy ideals i hope all could agree on.

    And I too am anything but a fan of lazy welfare cheats. Again, suitable and proportionate is the ideal, not so easy to achieve.


    IF they enjoyed it, it was not rape. People bring false charges of all sorts against eachother, by no means only rape; and false reporting should be harshly punished.

    Speaking from personal experience, being beaten, violated, terrorized, tortured and is not something a person gets to enjoy.

    Well you're right, I can't speak for those men like yourself who have been anally raped. While I do have symphathy for you, I don't know what exactly your particular case of rape has to do with the man/woman relationship of mine that you referred to.

    and current law allows a female to withdraw consent after the fact and claim rape. Doesn't make the ENTIRE definition of Rape correct.

    The law defines it as such. Wheter the law is adequate or not, I did not comment. Would be difficult, cause I suppose there are a lot of different laws against rape in the US alone.

    point is, is a citizen to just stand by and accept things "because it's the law"? Even if the law is unjust?


    if that were the case, the south would still have slavery.... safe to say it's a good thing someone questioned that law, huh?

    If you refer to some feminist demands to declare the man guilty with the accusation already; I think that feminists are scum. Simple as that. Anyway, these are special cases and everyone will hopefully agree that there must be laws against rape. I gave only a short response to a short question.

    we're on the same page.... sure there should be laws on rape. But there are things currently defined as rape, by law, that are not rape. Giving consent, having sex, and then withdrawing consent should not be included.... BY LAW.


    I protest that, not rape laws in general.

    Question. How would you find out who is lieing about rape.

    Would every rape case have to be done with a lie detector? would you have truth syrum and inject everyone?
    What would your way to determine if it was an actual rape or a no consent after the fact rape?

    by being allowed to ask tough questions of the girl.... but under current political correctness, noone is allowed to question the validity of a rape accusation.

    Look at the Duke Lacrosse story.... she claimed rape.... The coach of the team was fired, the boys were forced to withdraw from school, yet whenever someone tried to suggest that this girl, who had a history of false claims, may be making a false claim, women's libbers and blacks all called those people who questioned her story as racists and sexists to try and marginalize their questions of her integrity.

    And when the dust settled, guess what.... it all came out she made it all up, yet the coach didn't get his job back, the kids still didn't get to go to a prestigious school, the Duke Lacrosse season was cancelled....


    So, I want a fair trail if warranted, not a "the guy is guilty until proven innocent" media circus of public opinion

    One of the ways to tell is if she is beat up and shows the characteristic psychological signs of having been traumatized.

    As I said earlier, most women don't get beat up from the rape. Who is to say that the woman wasn't already traumatized or suffering from PTSD before the rape in question?

    a good sign for forced rape.... but date-rape allegations get tricky..... As usually there is no forced, or struggle, during sex.

    But investigators MUST be allowed to ask the hard questions..... questions like "were you drunk.... did the guy in question provide you in any way, those drinks, or had you been drinking prior to meeting him. why did you text your friend the next day complaining about how he didn't text you yet?"


    questioning can lead to determining if girl is upset that the guy didn't call back the next day and she's using daterape as revenge.




    on a side note.... I don't hear about false claims of forced rape. I hear date-rape claims all the time and it seems those are the kind of rapes that get false reported.

    I don't know if that's just observation, or the fact the media doesn't really report false reports of forced rape anymore. I imagine back in the 50's and prior, the false reports of forced rape had to do with white girl/black guy..... but it seems I don't hear of false reports of forced rapes.

    That's because there are very few forced rapes. Most of these women are happy that a guy took an interest in them and found them to be somewhat sexy, so its no surprise that there are so few claims of women getting raped.

    Forcible rape, as defined in the FBI’s Uniform Crime Reporting (UCR) Program, is the carnal knowledge of a female forcibly and against her will. Attempts or assaults to commit rape by force or threat of force are also included; however, statutory rape (without force) and other sex offenses are excluded.
    Data collection

    The UCR Program counts one offense for each female victim of a forcible rape, attempted forcible rape, or assault with intent to rape, regardless of the victim’s age. A rape by force involving a female victim and a familial offender is counted as a forcible rape and not an act of incest. All other crimes of a sexual nature are considered to be Part II offenses; as such, the UCR Program collects only arrest data for those crimes. The offense of statutory rape, in which no force is used but the female victim is under the age of consent, is included in the arrest total for the sex offenses category. Sexual attacks on males are counted as aggravated assaults or sex offenses, depending on the circumstances and the extent of any injuries.
    For this overview only, the FBI deviated from standard procedure and manually calculated the 2010 and 2011 rates of females raped based on the national female population provided by the U.S. Census Bureau.
    There were an estimated 83,425 forcible rapes reported to law enforcement in 2011. This estimate was 2.5 percent lower than the 2010 estimate and 9.5 percent and 12.4 percent lower than the 2007 and 2002 estimates, respectively. (See Tables 1 and 1A.)
    The rate of forcible rapes in 2011 was estimated at 52.7 per 100,000 female inhabitants.
    Rapes by force comprised 93.0 percent of reported rape offenses in 2011, and attempts or assaults to commit rape accounted for 7.0 percent of reported rapes. (Based on Table 19.)

    Nice spin.... noone suggested forcible rape doesn't exist, I pointed out how false claim of forced rape seem to be nonexistent since the 50s when it was used against blacks.

    Yeah, isn't mystery part of the turn-on when it comes to sex? Women shouldn't feel the need to tell their partner..."not tonight honey, I have a headache". All that nonsense is thrown out the window once the mysterious rapist enters through that very same window to please the distraught woman.
