Biden needs to proclaim that asylum requests from Mexico, and many other countries, will be denied, which is his power to do.

 

The law cannot restrict the President's powers over immigration. Congress can pass a law that says if an immigrant requests political asylum, then this or that action or procedure is followed.

But the law cannot interfere with the Presidential power to proclaim which countries have the political conditions present to warrant applications for political asylum in the first place.

Everyone knows that the POTUS can just unilaterally decide that no immigration from this or that country will be accepted. This is why I had to appeal to the practicality or honor (in regard to our Afghan allies) of Trump's so-called Muslim ban. But I knew that he had the power to do it; that wasn't the argument.
