this is my point.... When I say this, the femi-nazis on the forum come out with terms like mysogonist, or sexist, or whatever

but false rape accusations hurt women who have really been raped than anything else.

FSU qb got accused of rape. Nevermind it was because the girl's b/f caught her and she was trying to get out of it.
Kobe Bryant was guilty of adultery..... he's a dooshbag, but the colorado girl was trying to extort an NBA sized payday from him after she had consentual sex (oh yeah, it worked too)

Duke Lacrosse, the "victim" had made false reports of this nature before. A head coach of the team got fired (he wasn't even at the party) She was pissed that these rich white boys treated her like a stripper.....

    Real rape happens
    real date-rape happens

I have woken up next to girls that sober me should NEVER have taken home. but I can't call it rape the next morning because I regretted it. Calling that "date-rape" when it happens to a girl hurts the girl that had a roofie slipped to her who really was date-raped.

so is asking a drunk girl for sex considered attempted rape?

That's what I don't like about stats like you included here. I'm not claiming they are wrong, I have no doubt they are accurate or that you are making them up.... what I do question is what definition of "attempted rape" is being used.

slipping a roofie in a drink, but a bouncer sees you do it, and kicks you out..... attempted rape
a creepy looking guy asking an obviously impaired girl for a bj..... not attempted rape

It's rape whether it is male or female, don't paint everyone with the same brush just because some people have some strange opinions.

    I'd go with legal definition;

An undertaking to do an act that entails more than mere preparation but does not result in the successful completion of the act.

In Criminal Law, an attempt to commit a crime is an offense when an accused makes a substantial but unsuccessful effort to commit a crime. The elements of attempt vary, although generally, there must be an intent to commit the crime, an Overt Act beyond mere preparation, and an apparent ability to complete the crime.

Generally, attempts are punishable by imprisonment, with sentence lengths that vary in time, depending upon the severity of the offense attempted.

    No

    Probably not

    Again not.

    dude, make a point.

To the op - I haven't read the study, but it's probably due to an overly broad definition of rape. Some people include sex that's verbally consensual, but which one partner has an unvoiced discomfort with it, as rape. That is by far too broad. If a married woman wants to have sex and her husband verablly agrees to but feels to tired and secretly would rather just sleep, then by such broad definitions his wife is a rapist.

That's the thing, I've never seen people employing such broad definitions take them the other way.

that's fine that you see it that way, you have noble intentions.... but the people who need to paint as many women as possible as victims... the definitions of victim is expanded to include as many as possible.

a great question was asked and I haven't seen it answered.

If both people are drinking.... who date-raped the other?

I'll add a question... why can the woman be too drunk to be held accountable for saying yes, but a guy can't be too drunk for screwing that girl that said yes

I did answer the question in post #25 as follows - "Neither in this case, I should have made my comment clearer, sorry about that. "

    got it... sorry.

But many on here don't see it that way, so that's why I'm hesitant to take those stats you provided without a grain of salt. There are many that DO fudge the numbers to promote their agenda.

On this forum, when I described the situation where the sober girl came and got my EXTREMELY trashed butt and then had sex with me, many 'blamed the victim' by calling me an alcoholic. I then furthered my story and told them about, same girl, got drunk-wasted herself, a few weeks later, and called me to give her a ride. I went out and picked her up and as I was driving her home, she said she'd have sex with me if she wasn't on her period. I told her she could thank me for the ride with a blowjob, which she did. It was very enlightening to watch the same people that called me an alcoholic and dismissed my drunken night, turn right around and say I date-raped her when she was the drunk one and I was sober

It's either both are date-rape, or neither. If you want to really help women who are raped, then you have to be honest with how you define rape. If I date-raped her when she was drunk and I was not, then she date-raped me when I was drunk and she wasn't.

since that girl, I have met and become engaged (the "date-rapes" happened in december of 12 and January 13).... lol... in fact, this weekend is a year since I "date-raped" her.... because I met my current fiance the next weekend and our 1 year anniversary is next weekend.... but this same girl text me again needing a ride home in August or so and I had to tell her I couldn't because I was out with my current g/f.

so despite the femi-nazi beliefs, some women just want the D when drunk as much as guys want the V when they are drunk..... But I'm sure somewhere, this girl was included in a stat that says includes her in the 1/4 of all women who have been raped.

According to these definitions I’ve been raped, and a woman also attempted to rape me, but I don’t believe I was neither raped or the woman attempted to rape me. But If I were a woman and I answered the questions on these studies, I would be counted as both.
I was with a woman when she got on top and attempted to insert my P in her V before I had a chance to put on a condom. When she was on top, and she had my P in her hand, I told her, “I want to put on a condom” With which she then said, “It’s ok” and she proceeded to try again, with which I said “No, I really want to put on a condom” with which she replied, “OK”
But according to the Koss study if I were a woman this wasn’t just an attempted rape, this was rape!

And according to the 1 in 6 study, if I were a woman this was attempted rape!

But it was neither. I continued to see this woman and we had sex multiple times. Similarly, 43% of the women who were counted as rape victims by Koss had subsequent sexual encounters with their, ‘rapists’
Moreover nearly ¾ of the women Koss counted as rape victims said they were never raped.

Could be right, but I don't think that the National Institute of Justice & Centers for Disease Control & Prevention would 'fudge' the numbers.

IMO if either party are drunk then they are not capable of making an informed decision and if either continue to pressure for sex and achieve their aim then that is rape, doesn't matter to me whether it is a man or woman doing it, both are as guilty.
I have no doubt that there are some people who demean a man in this position, what they don't seem to realize is that all it does is lower the credibility of the position and lower rape to the very point it stands now. I also have no doubt there are women out there who use rape for some of the reasons already quoted and it is no surprise to me that authorities are coming to treat rape accusations with more than a little doubt .. To many crying wolf and soon people stop listening, all this does is leave those with real cause to report rape a little less believed, and that is wrong.
All accusations of rape should be investigated .. however if it is found that the accusation is false then the woman or man who made the accusation should be prosecuted to the fullest extent of the law. It doesn't help when so called celebrities are accused of rape and then settle out of court, this does nothing but cast doubt upon their innocence, if they did nothing wrong then they should go to court and show they did nothing wrong.

    Agreed

Congratulations, I hope everything works out well for you both.

I just think that some feminists go to far and fail to see that what they do actually diminishes the message.

That's another reason feminism isn't in women's best interests. The only people who benefit from feminism are feminists. Feminism isn't in anyones best interest women, children, men, anyone

Feminists broad definition of rape trivializes the experience of women who've actually been raped.

This is yet another reason why feminism is not in women's best interests.

If I were a rape victim, an actual rape victim, I would be furious that feminists trivialize my experience by equating it with someone who had a couple drinks, had consensual sex, and regretted it the next day-furious

ALL women will be raped at some point in their lives - this is because, oftentimes, intercourse is not desired by the woman, and is only used as a tool.

I wonder how many cases are counted as "rape" whenever a guy Mod Edit ~ Rule 9/Circumventing profanity filter his g/f consentually, then breaks up with her right after.

sorry girls... you can't call rape after you said yes and then get your feelings hurt.

If the guy in prison genuinely gave consent, then it would be a non-issue.

There are innocent people in prison for ALL kinds of crimes.
So why the focus on rape?
Why not focus on cleaning up the justice system for everyone and any crimes they may be accused of?

Because that is what the thread is about.

You can find other threads which discuss the overall problems with the justice system

Rape is a crime....it should, and is, handled like any other crime and LIKE ANY OTHER crime there are mistakes.
I think that rape being singled out here has nothing to do with the OP wanting justice for EVERYONE.

Because when it comes to rape, men are guilty until proven innocent.

The thread and the OP is specifically about rape.

If you wish for justice for everyone fine rape still needs to be specifically addressed.

Unlike other crimes ( robbery burglary murder ) a rape accusation can be easily falsified.

Robbery and burglary ( any legal definition of theft ) cannot be easily faked because something has to be stolen before the accusation can be made. It is rather hard to accuse someone of stealing your car if you still have possession of the car. It is impossible to accuse someone of murder if the victim is still alive.

Rape is an exception to this. A woman can ( and many do ) accuse a man of rape without a shred of evidence that the crime even occured in he first place. It is not about mistakes which can happen in any crime. Sure some have been wrongfully accused of murder when someone was in fact murdered. This mistake simply means the courts convicted the wrong suspect.

Another big difference in the way that rape and other crimes are handled is that there are seldom any consequences for fraudulent accusations which is also another reason why many women make such accusations. If you report your car stolen and they find out you lied you are likely to get arrested especially if you made an insurance claim. Very seldom to fraudulent rape victims get arrested.

If you want justice for everyone make it clear that women need to prove the crime first and formemost. If a woman accuses someone of rape and fails to provide evidence such as undergoing a medical rape test then it is almost certian to be her word against his and that is not enough to prosecute. If a woman makes an accusation which turns out to be false she should be arrested, charged and prosecuted.

That's exactly the way it is.....so there's no problem, just a whiney rant.

    Regret doesn't constitute rape
being so drunk you lose all inhabitations doesn't constitute rape
finding out he is involved with another or married doesn't constitute rape
him not calling you afterwards doesn't constitute rape
him not wanting a relationship doesn't constitute rape
him sweet talking you into it doesn't constitute rape
him not spooning or cuddling afterwards doesn't constitute rape
it being bad sex doesn't constitute rape
