    It's just bloviating... in an actual honest courtroom, they'd be exposed.

    Problem is - do we gave any honest courtrooms left?? I doubt it.

    If we are to believe the Trumpers around here this should be the easiest win in legal history. Apparently there is a ton of evidence that these machines were used to produce a fraudulent result. All Fox have to do is present the evidence in court and they win!

    Of course, those of us still in touch with reality know that the 'evidence' is a joke. Watching Trumpers make up excuses should be grimly amusing.

    Yes, Fox will tell them to piss off and sue.

    Lots of people willing to swear affidavits you know. Whether the contents are relevant, well that does not matter so long as you hold up a large white tome and tell the Judge you have lots of sworn affidavits and just to make sure, you tell the Judge, Rudy style, that affidavits are sworn, and they are evidence (does not matter what they might be evidence of) just like people are sworn in the box, 'cause Judges sometimes forget that little detail, ya know what I mean?

    I wish it was hard to believe. I really, really do.

    Twenty years ago I would have agreed with you, even after 8 years of anti-Clinton conspiracy theories. Even 10 years ago I would probably have chosen to beleive that Birtherism was just about a black guy being President and not even more fundamentally about the GOP voter base seceding from reality & wrapping itself in conspiracy theories & victimhood myths.

    Now, after watching 4 years of increasingly cultlike devotion to Trump and the replacement of any disagreeable piece of reality with conspiracy theories I expect it. This is no longer a group of people who have any interest in truth, reality or fact. They have fully retreated into an increasngly extreme echo chamber. If court cases don't go their way then it isn't proof that they are wrong, but that judges are corrupt or part of the mythical 'deep state'. The Party of Lincoln is now the Party of Q.

    As someone watching from the outdise you have my sympathy & my best wishes. I don't know how a democracy deals with tens of millions of armed people who no longer accept election results that don't go their way and a major political party that encourages them. I hope you can find a peaceful way to return to normality.

    If they're going to sue for defamation they need to prove at least three things 1. That the information reported about them was deliberately inaccurate, 2. That the reports were not speculative in nature, and 3. That their company was impacted financially from these reports

    Agreed. Either you’re wrong about your election conspiracy theories are there are no honest courtrooms left. But you’re never wrong about anything. So obviously there are no honest courtrooms left.

    I doubt that they'll have any difficulty in this.
    The claims could have and would have been definitively refuted if they had asked which is normal procedure for a news outlet. Many of the accusations were made by the FOX et al people themselves and not citing what others have said with the disclaimer that so and so was reached for comment, in fact no disclaimers at all and no attempts to reach for comment.

    Financial impact is what they wish to prevent and is not a requirement except in cases of restitution. If you start saying Rumpelstiltskin has a puppy mill that he uses for sexual gratification he has every right to sue you for defamation.

    I think it's a little different when it is a company filing a defamation lawsuit rather than an individual, but of course I could be wrong

    Awesome. Hope they are ready for the discovery process. Discovery guarantees they will have to expose their source code to scrutiny. Machines should never count votes again in an American election.

    They dont have to do anything of the sort. All they have to do is to prove that they were harmed by the false reporting. It has absolutely nothing to do with their “source code”, it has to do with FACTS. The accusations made by them have to be proven WHEN THEY MAKE THEM.

    The only way that this company can prove themselves innocent of the accusations is by exposing their source code and FOX is absolutely going to demand it in discovery.

    BTW, if you believe the company to be innocent of the accusations YOU SHOULD WANT THIS. The fact that you do not is indicative of your lack of faith in their innocence.
